AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, APPROVING ZONE CHANGE NO. 01-002
(MASTER CASE 01-254) FOR THE WILEY CANYON CONDOMINIUM DEVELOPMENT
PROJECT, AND SUNSHINE DAYCARE LOCATED AT
23720 AND 23706 WILEY CANYON ROAD
WHEREAS, the City Council does hereby make the following findings of fact:
a. The applicant, Newhall Land and Dick DeBeikes, proposed and initiated a
zone change on July 18, 2001 of certain uninhabited property, and a parcel
containing a daycare facility located at 23720 and 23706 Wiley Canyon Road
as described and shown on Exhibit A, for the purpose of changing the zoning
designation from Commercial Neighborhood (CN) with a PD (Planned
Development) Overlay to RMH (Residential Medium High).
b. Such a Zone Change would become effective upon City Council approval and
adoption of a resolution, adopting the Mitigated Negative Declaration.
C. The initial study and Mitigated Negative Declaration prepared for the project
is being adopted by separate resolution. -
d. The Planning Commission held a duly noticed public hearing on the Wiley
Canyon Condominium Development project and Sunshine Daycare
entitlements, including Zone Change 01-002 on November 6, 2001. On
November 6, 2001, the Planning Commission adopted a recommendation that
the City Council approve TTM 53588, adopt the Resolution approving the
Mitigated Negative Declaration prepared for the project, approve the zone
change, general plan amendment, and tentative tract map. Notice of said
public hearings was given in the manner required by the Santa Clarita
Municipal Code and State law.
e. The City Council held a duly noticed public hearing on the Wiley Canyon
Road Condominium Development project and Sunshine Daycare
entitlements, including Zone.Change 01-002 on November 6, 2001.
WHEREAS, based upon the testimony and other evidence received at the hearing,
and upon the study and investigation made by the Planning Commission and City Council
and on its behalf, the City Council further find as follows:
a. The purpose of the proposal is to Zone Change the project site from
Commercial Neighborhood (CN) with a Planned Development (PD) Overlay to
Residential Medium High (RMH) zone on the project site.
b. That with this request, the zoning designation and City's General Plan
designation for the site would be consistent.

C. Public participation and notification requirements pursuant to Sections
65090 and 65391 of the Government Code of the State of California were duly
followed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 3. FINDINGS FOR ZONE CHANGE. Based upon the foregoing facts
and findings, the City Council hereby finds as follows:
a. The proposed zone change from CN (Commercial Neighborhood) with a PD
(Planned Development) overlay to RMH (Residential Medium High) is
consistent with the objectives of the City's Unified Development Code and the
City's General Plan because the proposed residential development, and
existing daycare facility are uses permitted with the proposed zoning
designations, and the proposed use would be developed in a compatible
nature.
SECTION 2. The City Council hereby approves Zone Change 01-002 consisting of
the Wiley Canyon Condominium Development project and adjacent Sunshine Daycare
facility area to Residential Medium High (attached as Exhibit A).
SECTION 3. This Ordinance shall become effective at 12:01 a.m. on the thirty-first
day after adoption.
SECTION 4. The City Clerk shall certify as to the passage of this Ordinance and
cause it to be published in the manner prescribed by law.
