A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, ADOPTING THE IMPACT FEE REDUCTION
AND THE DEFERRED REVENUE AGREEMENT DEAL POINTS FOR THE
200 -UNIT AFFORDABLE SENIOR HOUSING PROJECT LOCATED EASTERLY
OF SIERRA HIGHWAY AT THE TERMINUS OF THE PROPOSED
FLYING TIGER DRIVE (LOT 4 OF PARCEL MAP 25916)
WHEREAS, the City Council of the City of Santa Clarita, does hereby resolve as follows:
FINDINGS OF FACT. The City Council does hereby make the following findings of fact:
a. On February 6, 2001, an entitlement application was filed with the Planning &
Building Services Department which included the following requests: an
amendment to the General Plan Land Use Element Land Use Map to
redesignate approximately 5.84 acres of Community Commercial (CC) land use
to Residential High (RH) land use; a zone change modifying the Unified
Development Code Zoning designation and standards of approximately 5.84
acres of property from Community Commercial (CC) to Residential High (RH)
zoning designation; a conditional use permit to allow for the construction of a
four-story building exceeding 35 feet in height; and a variance to waive the
Unified Development Code requirement to provide 250 cubic feet of lockable,
enclosed storage space per unit; and
b. On February 14, 2001, the application was deemed to be complete and consistent
with the Submittal Requirements of the City of Santa Clarita; and
C. On November 6, 2001, the Planning Commission of the City of Santa Clarita
conducted a duly noticed public hearing for the proposed 200 -unit affordable
senior housing project. The public hearing was held at 7:00 p.m. at City Hall,
Council Chambers, 23920 Valencia Boulevard, Santa Clarita; and
d. The Planning Commission fully considered all testimony and evidence regarding
the proposed 200 -unit affordable senior housing project consisting of General
Plan Amendment 01-002, Zone Change 01-001, Conditional Use Permit 01-003,
Variance 01-002 (Master Case 01-047) and made a recommendation for approval;
and
e. On November 27, 2001, the City Council of the City of Santa Clarita conducted
a duly noticed public hearing for the General Plan Amendment, Conditional Use
Permit, Variance, Negative Declaration, and first reading of the Zone Change for
the proposed 200 unit affordable senior housing project. The public hearing was
held at 6:00 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard,
Santa Clarita; and
f. The City Council of the City of Santa Clarita approved the General Plan
Amendment; Conditional Use Permit, Variance, and Negative Declaration for
the proposed project; and
g. On December 11, 2001, the City Council of the City of Santa Clarita approved the
Zone Change; and
h. On January 22, 2001, the City Council of the City of Santa Clarita held a hearing
for the proposed impact fee reductions and deferred revenue agreement for the
proposed 200 -unit affordable senior housing project. The hearing was held at
6:00 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard, Santa
Clarita; and
i. On January 22, 2001, the City Council of the City of Santa Clarita conceptually
approved the impact fee reductions and deferred revenue agreement, subject to
City Attorney review; and
j. On March 12, 2002, the City Council of the City of Santa Clarita approved the
impact fee reductions and deferred revenue agreement deal points;
APPROVAL. The City Council of the City of Santa Clarita approves the following:
a. Direct the City Manager to execute an agreement with the following
specifications:
1. Approve a project specific impact fee reduction of $946,482 by not
collecting the full fees ($1,994,940 fee); therefore, the developer's reduced
fees would total $1,048,458, which includes a 55% reduction in Bridge
and Thoroughfare District Fees ($630,000), 30% reduction in Parkland
Dedication Requirement Fees if the applicant provides 24,173 square feet
of on-site recreational space ($388,458), and a 25% reduction in Transit
Impact Fees ($30,000) for a total of $1,048,458.
2. Approve a Deferred Revenue Agreement to delay payment of $1,048,458
to be paid at 3% interest over a 13 -year period. The deferred revenue
agreement will require the applicant to commence payments prior to the
issuance of a Certificate of Occupancy.
