HomeMy WebLinkAbout2002-05-28 - RESOLUTIONS - RELIGIOUS INSTITUTION MODULAR (2)RESOLUTION NO 02-87 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AFFIRMING THE DECISION DENYING AN APPEAL OF THE PLANNING COMMISSION APPROVAL OF CONDITIONAL USE PERMIT O1-022, A REQUEST FOR A PRESCHOOL AND A 1,920 SQUARE FOOT MODULAR BUILDING ON A SITE DEVELOPED WITH A RELIGIOUS INSTITUTION WITHIN THE RESIDENTIAL SUBURBAN (RS) ZONE LOCATED AT 23023 HILSE LANE WHEREAS, the City Council of the City of Santa Clarita (hereafter "City") hereby makes the following findings of fact: A. An application for Master Case 01-354 (Conditional Use Permit 01-022) was filed by Temple Beth Ami (the "applicant") with the City of Santa Clarita on September 28, 2001. The property for which this application was filed is located at 23023 Hilse Lane. The General Plan and Zoning designation for the property is RS (Residential Suburban) to permit the operation of a preschool and the installation of a modular building. The proposed application was reviewed by staff and deemed complete on December 21, 2001. B. The surrounding land uses include vacant land to the north, residential to the east and south (across Hilse Lane) and a religious institution (Jehovah's Witness Kingdom Hall) to the west. C. A public hearing was duly noticed for the Planning Commission meeting of January 15, 2002, which was held at 7:00 p.m. in the City Hall Council Chambers, 23920 Valencia Boulevard, Santa Clarita, CA. During this meeting, the Planning Commission received the staff report and public testimony on the project; D. The January 15, 2002 Planning Commission hearing was continued to February 5, 2002, which was held at 7:00 p.m. in the City Hall Council Chambers, 23920 Valencia Boulevard, Santa Clarita, CA. During this meeting, the Planning Commission received the staff report, public testimony and resolution of denial for the project; E. The February 5, 2002 Planning Commission hearing was continued to March 19, 2002, which was held at 7:00 p.m. in the City Hall City Council Chambers, 23920 Valencia Boulevard, Santa Clarita, CA. During this meeting, the Planning Commission received the staff report, public testimony and resolution of approval for the project; F. On March 19, 2002, the Planning Commission heard the item, closed the public hearing and continued the item to April 16, 2002; G. On April 16, 2002, the Planning Commission held a meeting at 7:00 p.m. in the City Hall City Council Chambers, 23920 Valencia Boulevard, Santa Clarita, CA. During this meeting, the Planning Commission received the staff report and discussed the item; Resolution No. 02-87 Page 2 H. The Planning Commission approved the request on April 16, 2002. I. The appellants, the residents of Hilse Lane, submitted a letter on April 26, 2002, requesting an appeal of the Planning Commission's decision. J. A public hearing was duly noticed for the City Council meeting of May 28, 2002, which was held at 6:30 p.m. in the City Hall CouncilChambers, 23920 Valencia Boulevard, Santa Clarita, CA. During this meeting, the City Council received the staff report and public testimony on the project. K. The application was heard before the City Council on May 28, 2002 and was approved by the Council for the applicant to operate a 45 -student preschool and install a 1,924 square foot modular building. WHEREAS, the City Council, based upon the findings set forth above, hereby finds that Negative Declaration for this project has been prepared in compliance with CEQA: A. An Initial Study and a Negative Declaration for this project have been prepared in compliance with the California Environmental Quality Act (CEQA). B. The Initial Study has been circulated for review and comment by affected governmental agencies and the public, and all comments received, if any, have been considered. The public review period was open from December 21, 2001 through January 15, 2002. C. Said study found that no adverse impacts to the existing and future environmental resources of the area would result from the project, and the proposed Negative Declaration was posted and advertised on December 24, 2001 in accordance with CEQA. D. The Negative Declaration reflects the independent judgement of the City of Santa Clarita. WHEREAS, in malting its determination regarding the conditional use permit application, the City Council has considered certain principles and standards, and finds and determines as follows: A. That the proposed location, size, design, and characteristics of the proposed use are developed in accordance with the purpose of the Unified Development Code, the purpose of the Residential Suburban zone in which it is located, the Santa Clarita General Plan and the development policies and standards of the City. The UDC permits preschools and modular buildings on sites that have religious institutions that are conditionally approved within the (RS) Residential Suburban zone. The religious institution was developed in 1957 and was developed in substantial conformance to the approved site plan. In addition, with the installation of the modular building, the site will be improved with the conditions of approval to meet current code requirements for landscaping and parldng requirements. Resolution No. 02-87 Page 3 B. That the location, size, design, and characteristics of the proposed modular building and preschool, as conditioned, complies with the performance standards of the existing Residential Suburban zoning designation, and therefore are compatible with and will not adversely affect or be materially detrimental to adjacent residences or natural resources, with consideration given to; Harmony in scale, bulk, coverage, and density because the modular building is 1,920 square feet and complies with all development standards. 2. The availability of public facilities, services, and utilities because the project site is fully improved with adequate services to serve the existing use and the proposed preschool use. 3. The proposed addition and preschool use will not have harmful effect on desirable neighborhood character because the site is currently developed as a religious institution and the use will continue to operate in harmony with the existing neighborhood. In addition, the preschool will operate between the hours of 8:00 a.m. and 5:00 p.m. and will not have a harmful effect on the neighborhood and therefore, the proposal will not have any adverse impacts to the neighborhood. 4. The proposed use will not have a substantial impact regarding the generation of traffic and the capacity and physical character of surrounding streets because the additional trips which total between 140 and 160 vehicle trips per day can be accommodated by the existing roadway. 5. The suitability of the site for the type and intensity of use or development which is proposed because the site was approved for a religious institution and the proposed modular is a minor expansion along with a preschool to the conditional use permitted on the subject site. 6. The harmful effect, if any, upon environmental quality and natural resources. C. That the proposed location and general operating characteristics of the preschool and the installation of a modular building will not conflict with neighboring uses and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare, or be materially injurious to properties or improvements in the vicinity because the use have a limited number of students and hours of operation. D. That the installation of the modular building and the operation of the preschool will comply with each of the applicable provisions of Unified Development Code, as conditioned. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Santa Clarita, California, as follows: SECTION 1. The City Council hereby approves Master Case 01-354 to operate a preschool.andinstall a 1,920 square foot modular building. Resolution No. 02-87 Page 4 SECTION 2.
