HomeMy WebLinkAbout2002-05-14 - RESOLUTIONS - SANDIST 32 ANNEX 260 (2)RESOLUTION NO. 02-59 JOINT RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES ACTING IN BEHALF OF Los Angeles County General Fund Los Angeles County Library Los Angeles County Flood Control Los Angeles County Consolidated Fire Protection District Los Angeles County Fire - FFW THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 32 OF LOS ANGELES COUNTY, AND THE GOVERNING BODIES OF City of Santa Clarita Castaic Lake Water Agency Greater Los Angeles County Vector Control District Newhall County Water District Santa Clarita Street Lighting Maintenance District No. 2 APPROVING AND ACCEPTING NEGOTIATED EXCHANGE OF PROPERTY TAX REVENUES RESULTING FROM ANNEXATION TO COUNTY SANITATION DISTRICT NO. 32. "ANNEXATION NO. 260" WHEREAS, pursuant to Section 99 and 99.1 of the Revenue and Taxation Code, prior to the effective date of any jurisdictional change which will result in a special district providing a new service, the governing bodies of all local agencies that receive an apportionment of the property tax from the area must determine the amount of property tax revenues from the annual tax increment to be exchanged between the affected agencies and approve and accept the negotiated exchange of property tax revenues by resolution; and WHEREAS, the governing bodies ofthe agencies signatory hereto have made determinations of the amount ofproperty tax revenues from the annual tax increments to be exchanged as a result of the annexation to County Sanitation District No. 32 entitled Annexation No. 260; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The negotiated exchange ofproperty tax revenues resulting from the annezAtion of territory to County Sanitation District No. 32 in the annexation entitled Annexation No. 160 is approved and accepted. 2. For each fiscal year commencing on and after July 1, 2003, or after th"- ffective date of this jurisdictional change, whichever is later, the County Auditor shall transfer to Counr,�.Sanitation District No. 32 a total of 1.1058 percent of the annual tax increment attributable to the land area ene6mpassedwithin Annexation No. 260. - Said percentage has been determined on the basis of the following contributions. AGENCY PERCENT Los Angeles County General Fund 0.4836 Los Angeles County Library 0.0398 Los Angeles County Flood Control 0.0191 Los Angeles County Consolidated Fire Protection District 0.2743 Los Angeles County Fire - FFW 0.0229 City of Santa Clarita 0.1139 Castaic Lake Water Agency 0.1128 Greater Los Angeles County Vector Control District 0.0006 Newhall County Water District 0.0042 Santa Clarita Street Lighting Maintenance District No. 2 0.0346 TOTAL 1.1058 3. No additional transfer ofproperty tax revenues shall be made from any other taxing agencies to County Sanitation District No. 32 as a result of annexation entitled Annexation No. 260. 4. No transfer of property tax increments from properties within a community redevelopment projectwhich are legally committed to a Community Redevelopment Agency shall be made during the period that such tax increment is legally committed for repayment of the redevelopment project costs. 5. If at any time after the effective date of this resolution, the calculations used herein to determine initial property tax transfers or the data used to perform those calculations are found to be incorrect thus producing an improper or inaccurate property tax transfer, the property tax transfer shall be recalculated and the corrected transfer shall be implemented for the next fiscal year, and any amounts of property tax received in excess of that which is proper shall be refunded to the appropriate agency. The foregoing resolution was adopted by the Board of Supervisors of the County of Los Angeles, the Board ofDirectors of County Sanitation DistrictNo. 32 of Los Angeles County, andthe govemingbodies of City of Santa Clarita, Castaic Lake Water Agency, Greater Los Angeles County Vector Control District, Newhall County Water District, and Santa Clarita Street Lighting Maintenance District No. 2, signatory hereto.
