RESOLUTION NO. 02-22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA ADOPTING THE NEGATIVE DECLARATION PREPARED FOR THE PROJECT AND APPROVING MASTER CASE 01-068, GENERAL PLAN AMENDMENT 01-005, TO ALLOW FOR THE LAND USE DESIGNATION CHANGE OF THE STONECREST ANNEXATION AREA LOCATED NORTH OF SOLEDAD CANYON ROAD AND THE ANTELOPE VALLEY FREEWAY AND EAST OF SHADOW PINES BOULEVARD ADJACENT TO CITY OF SANTA CLARITA BOUNDARIES. THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby make the following findings of fact: a. On December 14, 2000, residents of the Stonecrest subdivision submitted a petition signed by a majority of property owners in the Stonecrest subdivision to annex into the City of Santa Clarita. On December 15, 2000, the petition was accepted as a valid petition by City staff, and a logical boundary of the proposed annexation area was developed. b. The site is located adjacent to the eastern boundary line of the City of Santa Clarita, north of Soledad Canyon Road and east of Shadow Pines Boulevard in the area known as Canyon Country. C. The land use to the west consists of single-family residential, within the City of Santa Clarita. The land to the north and east of the Stonecrest subdivision is vacant and is outside of the City of Santa Clarita, and Soledad Canyon Road and the Antelope Valley Freeway is located to the south of the project area. d. The City of Santa Clarita Development Review Committee met and reviewed the proposed land use designation change on January 10, 2001. e. No development is proposed with this land use designation change f. The Planning Commission held a duly noticed public hearing on this issue on January 15, 2002. This public hearing was held at 7:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarita. At the hearing, the Planning Commission considered staff and consultant presentations, staff reports, applicant presentations, public testimony on the proposal, and the Mitigated Negative Declaration prepared for the project. The Planning Commission recommended approval of the Negative Declaration prepared for the project, and the General Plan Amendment, and prezone (adopted by separate ordinance). g. Public participation and notification requirements pursuant to Sections 65090, 65391, and 65854 of the Government Code of the State of California were duly followed. Resolution 02-22 Page No. 2 h. The City Council held a duly noticed public hearing on the entitlements, including Prezone 01-001 (adopted by separate ordinance) on February 12, 2002. The public hearing on the project was held at 6:00 p.m., at the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita. The City Council public hearing was advertised in the Signal on December 17, 2001, by direct first-class mail to property owners within 500 feet of the project area and posting in the local paper. SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS Based upon the testimony and other evidence of received, the Planning Commission further finds as follows: a. A Mitigated Negative Declaration has been prepared for this project and circulated in compliance with the California Environmental Quality Act and adopted as certified as required by that Act. b. Said study found that no adverse impact to the existing and future environmental resources of the area would result from the proposed land use change. C. The Initial Study has been circulated for review and comment by affected governmental agencies and the public, and all comments received, if any, have been considered. The public review period was from December 17, 2001 to January 15, 2002. d. The proposed project would not have a significant adverse effect on the environment and a proposed Mitigated Negative Declaration was posted and advertised on December 17, 2001, in accordance with the California Environmental Quality Act (CEQA). e. The Negative Declaration reflects the independent judgement of the City of Santa Clarita. The City Council, based upon the finding set forth above, hereby finds the Negative Declaration for this project to has been prepared in compliance with CEQA. SECTION 3. GENERAL PLAN FINDINGS Based upon the foregoing, the City Council does hereby approve the General Plan Amendment and the General Plan Land Use Map is hereby amended to designate the subject property RS (Residential Suburban); a. So the City's General Plan and Zoning designations for the site remain consistent, and the existing single-family detached uses of the site are consistent with the development standards in the proposed zoning designation, the proposal includes amending the General Plan and to change the zone the project site from City of Santa Clarita RL (Residential Low) to City. of Santa Clarita RS (Residential Suburban). Resolution 02-22 Page No. 3 b. That a General Plan Amendment to the Land Use Element is necessary to change the land use designation from RL (Residential Low) to RS (Residential Suburban) for the existing single-family residential uses on-site, approved by separate resolution so the City's General Plan and Zoning designations remain consistent. SECTION 4. The City Council hereby approves Master Case 01-068 which includes General Plan Amendment 01-005 (herein included as Exhibit A) to amend the General Plan Land Use Element for the Stonecrest Annexation Area from Residential Low (RL) to Residential Suburban (RS) and adopts the Negative Declaration prepared for the project (Prezone 01-001 is adopted by separate ordinance). SECTION 5. The City Clerk shall certify to the adoption of this Resolution and certify this record to be a full, complete, and correct copy of the action taken.
