HomeMy WebLinkAbout2002-03-12 - RESOLUTIONS - SUMMARY VACATE TOWN CENTER APT (2)RESOLUTION NO. 02-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA VACATING PRIVATE AND FUTURE STREET, TRACT NO. 51931-02, LOTS 17,18 AND 19 (TOWN CENTER APARTMENTS) IN THE CITY OF SANTA CLARITA WHEREAS, the construction of Creekside Road and Fairways Drive within lots 17, 18, and 19 of Tract No. 51931-02 was completed and final tract alignments are set which deem a portion of private and future street easement excessive, and the developer requests that the easement be vacated; and WHEREAS, the proposed vacation was reviewed and a notice of exemption for the vacation of the public service easement in compliance with the California Environmental Quality Act was certified, and such notice was filed with the County Clerk of the County of Los Angeles; and WHEREAS, under Chapter 4, Summary Vacation, of Part 3 of Division 9 of the Streets and Highways Code of the State of California, no public hearing is required and no public hearing was held. THEREFORE, pursuant to the provisions of Section 8334 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, California, does resolve, declare, determine, and order as follows: SECTION 1. That it is hereby found and determined that the portion of private and future street easement, as described on Exhibit "B" and shown on Exhibit "B-1" and 'B-2" attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, County of Los Angeles, State of California, is no longer needed for present or prospective use based on the fact that this easement is an excess right-of-way no longer required. SECTION 2. That within the portion of private and future street easement to be vacated, no public utility facilities exist that would be affected by the vacation. SECTION 3. That City staff of the City of Santa Clarita is instructed to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles, at which time the easement vacated will no longer be a public service easement. r PASSED, APPROVED, AND ADOPTED this 12th day of March, 2002.
