RECOMMENDED ACTION
The City Council Legislative Committee recommends "support" for AB 1652. Statements of support
will be transmitted to Assembly Member George Nakano, Santa Clarita's state legislative delegation,
appropriate legislative committees, Governor Davis and the League of California Cities.
BACKGROUND
Assembly Bill 1652 (Nakano -D -Torrance) would increase the membership of the Los Angeles County
Metropolitan Transportation Authority (MTA) from 14 members to 16 members. The two new
members would be appointed by the Los Angeles County City Selection Committee to represent cities'
interests on MTA, exclusive of the City of Los Angeles.
Under existing law, the MTA Board is comprised of fourteen members; the five members of the Los
Angeles County Board of Supervisors, the Mayor of the City of Los Angeles, one member of the Los
Angeles City Council, two public members appointed by the Los Angeles City Council, and four
members representing the remaining cities, appointed by the Los Angeles County City Selection
Committee. The Governor also has a non-voting appointee to the MTA Board. The cities of Los
Angeles County, excluding the City of Los Angeles, are grouped into four sectors. Santa Clarita is
located in the North County/San Fernando Valley sector which is comprised of the cities of Agoura
Hills, Burbank, Calabasas, Glendale, Hidden Hills, La Canada-Flintridge, Lancaster, Malibu, Palmdale,
San Fernando, Santa Clarita and Westlake Village. A city's vote within each sector is weighted in the
same proportion its population is to the population of all cities within the sector. Each sector's
representative has a single vote at the MTA Board, weighted equally with every other voting member.

Assembly Bill 1652 would increase the MTA Board by two seats to sixteen members overall and create
two new city sectors. The Los Angeles County Division of the League of California Cities would be
charged with defining the six sectors and the composition of each sector. The Los Angeles County City
Selection Committee would continue to select the representatives from each sector.
Proponents of the bill argue that the four municipal appointees currently represent less than one-third of
the voting power of the MTA Board, yet represent 51% of the overall Los Angeles County population.
While the two additional seats will bring the voting power to 40%, they argue it represents a significant
step toward more proportionate representation.
Opponents, including the MTA Board, argue that the bill is simply Sacramento arbitrarily dictating
board composition rather than responding to locally raised concerns. The Amalgamated Transit Union
has taken an 'opposed unless amended" position advocating that expansion of the MTA Board should
include labor representatives.
Los Angeles County Supervisor Michael D. Antonovich and the Los Angeles County Division of the
League of California Cities have requested that the City of Santa Clarita support AB 1652. The City
Council Legislative Committee recommends "support" for AB 1652.
ALTERNATIVE ACTIONS
1. Oppose AB 1652.
2. Take no position on AB 1652 and direct staff to monitor the bill.
3. Other action as determined by the City Council.
FISCAL IMPACT
Adoption of the recommended action will not result in any additional fiscal impact to the City of Santa
Clarita. Staff time associated with the preparation of materials and conduct of communications with
Members of the California Legislature is included within the adopted 2002/03 City budget.

An act to amend Section 130051 of the Public Utilities Code, relating
to transportation.
LEGISLATIVE COUNSEUS DIGEST
AB 1652, as introduced, Nakano. Los Angeles County
Metropolitan Transportation Authority.
(1) Existing law provides for the membership of the Los Angeles
County Metropolitan Transportation Authority, which includes 4
members appointed by the Los Angeles County City Selection
Committee.
This bill would increase the number of members of the authority
from 14 members to 16 members and would increase the members
appointed by the Los Angeles County City Selection Committee to 6.
Because the bill changes the responsibilities of the authority, the bill
would impose a state -mandated local program.
(2) The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the state.
Statutory provisions establish procedures for making that
reimbursement, including the creation of a State Mandates Claims Fund
to pay the costs of mandates that do not exceed $1,000,000 statewide
and other procedures for claims whose statewide costs exceed
$1,000,000.
This bill would provide that, if the Commission on State Mandates
determines that the bill contains costs mandated by the state,

reimbursement for those costs shall be made pursuant to these statutory
provisions.

The people of the State of California do enact as follows:
1 SECTION 1. Section 130051 of the Public Utilities Code is
2 amended to read:
3 130051. The Los Angeles County Metropolitan
4 Transportation Authority consists of 44-16 members, as follows:
5 (a) Five members of the Los Angeles County Board of
6 Supervisors.
7 If the number of members of the Los Angeles County Board of
8 Supervisors is increased, the authority shall, within 60 days of the
9 increase, submit a plan to the Legislature for revising the
10 composition of the authority.
11 (b) The Mayor of the City of Los Angeles.
12 (c) Two public members and one member of the City Council
13 of the City of Los Angeles appointed by the Mayor of the City of
14 Los Angeles.
15 (d) Feu Six members, each of whom shall be a mayor or a
16 member of a city council, appointed by the Los Angeles County
17 City Selection Committee. For purposes of the selection of these
18 €ems six members, the County of Los Angeles, excluding the City

26 Every city within a sector shall be entitled to vote to nominate one
27 or more candidates from that sector for consideration for
28 appointment by the Los Angeles County City Selection
29 Committee. A city's vote shall be weighted in the same proportion
30 that its population bears to the total population of all cities within
31 the sector.

33 appointed by the Los Angeles County City Selection Committee

1 upon an affirmative vote of its members which represent a
2 majority of the population of all cities within the county, excluding
3 the City of Los Angeles.
4 The members selected by the city selection committee shall
5 serve four-year terms with no limitation on the number of terms
6 that may be served by any individual. The city selection committee
7 may shorten the initial four-year term for one or more of the
8 members for the purpose of ensuring that the members will serve
9 staggered terms.
10 (e) If the population of the City of Los Angeles, at any time,
11 becomes less than 35 percent of the combined population of all
12 cities in the county, the position of one of the two public members
13 appointed pursuant to subdivision (c), as determined by the Mayor
14 of the City of Los Angeles by lot, shall be vacated, and the vacant
15 position shall be filled by appointment by the city selection
16 committee pursuant to subdivision (d) from a city not represented
17 by any other member appointed pursuant to subdivision (d).
18 (f) One nonvoting member appointed by the Governor.
19 SEC. 2. Notwithstanding Section 17610 of the Government
20 Code, if the Commission on State Mandates determines that this
21 act contains costs mandated by the state, reimbursement to local
22 agencies and school districts for those costs shall be made pursuant
23 to Part 7 (commencing with Section 17500) of Division 4 of Title
24 2 of the Government Code. If the statewide cost of the claim for
25 reimbursement does not exceed one million dollars ($1,000,000),
26 reimbursement shall be made from the State Mandates Claims
27 Fund.

To enhance a regional transportation system, it is vital that our 87 cities have their
membership on the Los Angeles County Metropolitan Transportation Authority Board of
Directors increased.
The Board currently consists of the five Los Angeles County Supervisors, four members
from the City of Los Angeles, four members from the independent cities, and one ex -
officio member.
Assembly Bill 1652 (Nakano) adds two additional seats for the independent cities of Los
Angeles County and ends the parochialism that resulted in pouring billions of dollars
down a sinkhole in the City of Los Angeles -- while depriving other County areas of
badly needed transportation resources.
To achieve a truly regional system serving our County's 88 cities and
134 uni porated communities, this vital legislation deserves your support.

Dear Mayor Smyth,
The Los Angeles County Division of the League of California Cities strongly
supports Assembly Bill 1652 which is scheduled for hearing by the Assembly
Committee on Transportation on April 21.
The current make-up of the Los Angeles County Metropolitan Transportation
Authority (LAMTA) Board does not accurately depict the representation of Los
Angeles County. Of the 13 voting members on the Board, the County Board of
Supervisors represent five members, the City of Los Angeles has four mayoral
appointees, while the remaining 87 cities in Los Angles County have four
members. AB 1652 seeks to establish a more equitable and appropriate
representation by creating a Board that best reflects the diversity and needs of
the entire Los Angeles County.
Currently, the City Selection Committee appointments, comprised of four
representatives from 87 cities within the county, have less than one third of the
Board votes. Yet, they represent 51% of the county population and generate
63% of the Proposition A and C % cent sales tax revenue. This weakens the
ability of the majority of the county to participate in vital transportation policy
and programs. 'AB 1652 will correct this inequity by increasing the City
Selection membership from four to six; thereby amplifying its percentage of
Board votes from 30% to 40%. A modest realignment is a positive step to
ensure appropriate representation on the Board.
