HomeMy WebLinkAbout2003-02-25 - AGENDA REPORTS - AMEND CONFLICT INTEREST CODE (2)CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR DATE: February 25, 2003 City Manager Approval: Item to be presented by: Sharon Dawson SUBJECT: AMENDMENT TO CITY'S CONFLICT OF INTEREST CODE DEPARTMENT: Administrative Services RECOMMENDED ACTION Adopt a resolution adopting and incorporating by reference the Fair Political Practices Commission's standard conflict of interest code and updating the list of designated employees. BACKGROUND The Political Reform Act, Government Code Sections 81000, et seq. requires every local government agency to adopt and promulgate a conflict of interest code. Further, the Act requires each local government agency to review its conflict of interest code biennially or as needed to determine if it is accurate or if the code should be amended. The City Council originally adopted the City of Santa Clarita's Conflict of Interest Code on December 15, 1987 by Resolution 87-13. Since that time, the Code has been amended at least every two years to reflect changes in designated positions as well as changes in the State regulation to keep it up to date. The State regulation, 2 Cal. Code of Regs. Section 18730, contains the terms of a standard conflict of interest code, which may be incorporated by reference in a local government agency's code. If the City Council adopts this regulation and any amendments to it duly adopted by the Fair Political Practices Commission (FPPC), by reference, it would not be necessary for the City to amend its Code except for changes in designated positions. The regulation may be amended by the FPPC to conform to amendments in the Political Reform Act following public notice and hearings conducted by the FPPC. The FPPC recommends that agencies incorporate the regulation by reference which will ensure that the City's Code is in compliance with the Political Reform Act. Agenda Item: Adopted: eso O3 -o Recently, the Political Reform Act was amended to increase the gift limit from $320 to $340 in aggregate gifts from a single source in a calendar year, causing the City's Code to be outdated. Last year, several changes were made to the fair market value of investments or real property interests thresholds for reporting purposes. These types of changes would be incorporated into the State regulation upon adoption by the FPPC and the City's Code would not be out of date when such changes are made. Staff has also determined that the list of designated positions as Exhibit `B" to the proposed resolution needs to be amended to add the following positions: Administrative Aid Administrative Analyst — Film Administrative Analyst — Risk Management Information Technology Analyst Management Analyst Senior Management Analyst Changes in designated positions will continue to be reviewed as needed for consideration and adoption by the City Council. A proposed resolution has been prepared for Council to adopt and incorporate by reference the Fair Political Practices Commission's standard conflict of interest code, including an updated list of designated employee positions and disclosure categories to reflect the changes discussed.
