FT. IN ACCORDANCE WITH THE JOINT COLLECTION AGREEMENT BETWEEN THE CITY OF SANTA CLARITA AND THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY DEPARTMENT: Planning and Building Services RECOMMENDED ACTION Adopt Resolution to increase Fire District fees in accordance with the Los Angeles County adopted and updated Developer Fee Program. BACKGROUND Fire District Development fees pay for the construction of fire stations and related fire protection improvements identified in the Detailed Fire Station Plan that was approved and adopted by the County of Los Angeles. In accordance with the City's agreement with the County of Los Angeles to be part of the Consolidated Fire Protection District of Los Angeles County, the subject fee increase is proposed to match the fee increase recently adopted by the County under their Developer Fee Program. The subject fee will increase from $0.1977 to $0.3716 per square foot of new building floor area. It represents a significant increase due to the revised and updated Detailed Fire Station Plans, which identifies significant costs for needed fire stations that had not been forecasted under the previous estimates and development modeling. The increase will make these fees consistent with the amount collected by Los Angeles County for projects in the unincorporated areas. ALTERNATIVE ACTIONS There are no alternative actions as identified by staff. The agreement requires the City's participation. FISCAL IMPACT Minor administrative expense to collect the fee and transmit it to the County. ATTACHMENTS Resolution Developer Fee Detailed Fire Station Plan available in the City Clerk's Reading File CITY OF SANTA CLARITA NOTICE OF PUBLIC HEARING INTENTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA TO INCREASE THE DEVELOPER FEE FOR THE BENEFIT OF THE CONSOLIDATED FIRE PROTECTION DISTRICT OF LOS ANGELES COUNTY PUBLIC NOTICE IS HEREBY GIVEN: A public hearing will be held before the City Council of the City of Santa Clarita to consider and receive input relating to the intention of the Council to increase the City of Santa Clarita Developer Fee for the benefit of the Consolidated Fire Protection District by approximately 86% percent from $0.1997 to $0.3716 per square foot of new building floor area. This approximate 86% increase is based on information received by the Fire Department which reflects current average costs associated with land acquisition for a fire station site, fire station construction, equipment, and administrative costs associated with fee collection and project and facilities management. The public hearing will be held by the City Council in the City Hall Council Chambers, 23920 Valencia Boulevard, First Floor, the 23rd day of September, 2003, at or after 6:30 p.m. Proponents, opponents and any interested persons may be heard on this matter at this time. The Developer Fee Program is for the purpose of generating funds for capital projects necessary to maintain services within the existing service areas of the Consolidated Fire Protection District of Los Angeles County, and as such is statutorily exempt per Section 15273 (a)(4) of the California Environmental Quality Act guidelines developed by the State Office of Planning and Research. 3. On MAI Z-7 1 2003, a public hearing was held to update the Developer Fee Program and to consider: 1).the updated Developer Fee Detailed Fire Station Plan dated December 2002 (Attachment A) attached hereto and incorporated herein, which serves as the capital improvement plan and describes the acquisition, construction, installation, and equipping of fire stations; and 2) the 2002-03 Developer Fee Update Fee Calculation Summary (Attachment B) attached hereto and incorporated herein, which calculates the amount to be levied upon the parcels within the areas of benefit. 4. Based upon the December 2002 Developer Fee Detailed Fire Station Plan and the 2002-03 Developer Fee Update Fee Calculation Summary, there are reasonable relationships between: 1) the developer fee's use and the type of development projects in which the developer fee is imposed; 2) the need for fire station facilities and the type of development project on which the developer fee is imposed; and 3) the amount of the developer fee and the cost of all or a portion of the fire station facilities attributable to the development on which the developer fee is imposed. 5. The Board of Supervisors approves and adopts the updated Developer Fee Program for the benefit of the Consolidated Fire Protection District of Los Angeles County as follows: a) the December 2002 Developer Fee Detailed Fire Station Plan is approved and adopted; b) the 2002-03 Developer Fee Update Fee Calculation Summary is approved and adopted; c) the updated developer fee amount of $.3716 per square foot of the new floor areas of buildings is approved to be effective in the unincorporated areas within the areas of benefit the first day of the month following the date of the approval of this updated developer fee amount by the Board of Supervisors; d) The current developer fee rate of $.1997 will continue to be imposed on all development projects for which a qualified building permit application has been submitted prior to the effective date of the updated developer fee amount, and a building permit is issued for such building permit application within five months of such effective date; and e) all other terms and provisions of the Developer Fee Program as previously adopted by the Board of Supervisors of the County of Los Angeles shall remain unchanged and in full force and effect. -2- -FH The foregoing resolution was adopted on the Z1 day of MAI 2003, by the BOARD OF SUPERVISORS OF THE COUNTY OF LOS ANGELES.
