HomeMy WebLinkAbout2003-02-11 - AGENDA REPORTS - NPDES AMEND (2)CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approva Item to be presented by: Jason Smisko DATE: February 11, 2003 SUBJECT: ORDINANCE AMENDMENT REQUIRED BY THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT CONTROLLING DISCHARGES OF POLLUTANTS TO THE MUNICIPAL SEPARATE STORM SEWER SYSTEM (MS4); AND ORDINANCE AMENDMENT REQUIRED BY THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT REQUIRING THE IMPLEMENTATION OF THE STANDARD URBAN STORM WATER MITIGATION PLAN (SUSMP) FOR INDUSTRIAL AND COMMERCIAL DEVELOPMENT PROJECTS THAT DISTURB ONE ACRE OR MORE OF SURFACE AREA. DEPARTMENT: Field Services RECOMMENDED ACTION City Council introduce and pass to second reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, PROTECTING PUBLIC HEALTH AND SAFETY AND CITY PROPERTY BY CONTROLLING DISCHARGES OF POLLUTANTS AND PROHIBITING ILLICIT DISCHARGES AND ILLICIT CONNECTIONS TO THE MUNICIPAL SEPARATE STORM SEWER SYSTEM AND WATERS OF THE UNITED STATES BY AMENDING CHAPTER 10.04 OF TITLE 10 OF THE SANTA CLARITA MUNICIPAL CODE BY REPLACING IT IN ITS ENTIRETY WITH NEW CHAPTER 10.04 STORMWATER AND URBAN RUNOFF POLLUTION CONTROL;" and City Council introduce and pass to second reading an ordinance entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, IMPLEMENTING THE STANDARD URBAN STORMWATER MITIGATION PLAN OF THE CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD FOR THE LOS ANGELES REGION BY AMENDING CHAPTER 17.90 OF TITLE 17 OF THE SANTA CLARITA MUNICIPAL CODE BY REPLACING IT IN ITS ENTIRETY WITH NEW CHAPTER 17.90, STANDARD URBAN STORM WATER MITIGATION PLAN IMPLEMENTATION." Agenda Item: V�(XllillE61C� SSe� iU —5-C-"w1,Veath+' BACKGROUND The City of Santa Clarita as a co -permittee of the 2001 NPDES Permit is required by the permit to adopt and amend its own municipal and development codes in order to be consistent with the NPDES permit. Accordingly, the first attached ordinance report pertaining to stricter pollution control standards, prohibited activities and clarifying definitions, is to be amended by February 15, 2003. The second attached ordinance referring to requiring Standard Urban Stormwater Mitigation Plans (SUSMP) on properties greater than one acre is to be amended by March 10, 2003. The recommended actions of this agenda report make the City's stormwater ordinances consistent with the NPDES Permit and they keep the City in compliance with federal and state law. On December 13, 2001, the Los Angeles Regional Water Quality Control Board issued "ORDER NO. 01-182 NPDES PERMIT NO CAS004001 WASTE DISCHARGE REQUIREMENTS FOR MUNICIPAL STORMWATER AND URBAN RUNOFF DISCHARGES WITHIN THE COUNTY OF LOS ANGELES AND THE INCORPORATED CITIES THEREIN, EXCEPT THE CITY OF LONG BEACH" (the "2001 Stormwater Permit") to cities in Los Angeles County, including the City of Santa Clarita. This City has authority under Article 11, section 7 of the California Constitution to adopt ordinances needed to implement these requirements. This City also has authority under § 13002 the California Water Code to adopt and enforce ordinances conditioning, restricting, and limiting activities that might degrade the quality of the waters of the State of California. ALTERNATIVE ACTIONS No alternatives have been identified because state and federal laws require the City to take this action. FISCAL IMPACT The implementation of these regulatory requirements will increase the cost to the City by increasing staff time needed to enforce these regulations through increased inspections and issuance of violations. A portion of the costs incurred by the City may be reimbursed through fines acquired by such violations. Currently, there is not an official fine schedule for these violations. City staff anticipates including fines for these violations in the next Citywide fee update. The additional staff time needed to implement these requirements combined with other expanding provisions of the NPDES Permit not described here that the City is subject to will result in the City requesting a third Environmental Field Specialist Stormwater Inspector to meet the compliance demands of the 2001 NPDES permit.
