SUBJECT: REVIEW AND APPROVAL OF REQUEST FOR COMMERCIAL AND RESIDENTIAL SOLID WASTEPFRANCH FOR
AGREEMENTS

RECOMMENDED ACTION
Council review and approve all recommended changes to the RFP and Franchise
Agreements, and authorize staff to finalize the documents for release to potential bidders.
Council appropriate $50,000 from the Council Contingency Fund, Account No. 2250-7401, to
the Environmental Services Professional Services Account, Account No. 3811-8110 for
additional funds needed for technical and legal consulting assistance with the preparation of
the Commercial and Residential Solid Waste Franchise Request for Proposals and franchise
agreements.
BACKGROUND
At the February 25, 2003 City Council meeting, staff presented a redline version of the
Request for Proposals for Residential and Commercial Solid Waste Management Services
along with the corresponding redlined Residential and Commercial Solid Waste Franchise
Agreements. The documents were a result of Council direction from the October 1 and 24,
2002 Study Sessions, along with comments received during the public review and comment
period.
Pursuant to Council's direction at the February 25, 2003 Council meeting, staff is returning
with the redlined version of the Draft Commercial and Residential Solid Waste Franchise
RFP and Agreements. Along with the original redline changes, staff has incorporated the
additional six changes requested by Council at the last Council meeting. No other
modifications have been made to the draft documents. The additional changes consist of:
• Clarifying the section of the RFP that indicates that deviations from the RFP and
franchise agreements will be penalized while enhancements over and above the RFP
requirements are allowed and encouraged (RFP pg. 3).
• Revised timeline (RFP pg. 6).
• Provisions to include multi -family residences in the diaper recycling pilot program (RFP
pg. 17 & RFP Attachment 3B line 13).
• Changing the word 'occur" to "incur" for section 3.2.2 of the Residential and Commercial
Franchises (Residential Agreement pg. 21 and Commercial Agreement pg. 20).

FISCAL IMPACT
The additional anticipated cost for preparing the Solid Waste Franchise RFP is $50,000. The
proposed budget increase is to be transferred from the City Council Contingency Account No.
2250-7401 to Account No. 3811-8110. Pending the approval of the transfer of funds, the
remaining balance of the City Council Contingency Fund would be $1,195,421. It is
anticipated that all RFP related expenditures will be reimbursed to the City's General Fund
upon execution of the contract, during the 2003-2004 fiscal year.
