SUBJECT: TRACT MAP NO. 54271 (CONDOMINIUM MAP, NORTH
VALENCIA II ANNEXATION, SOUTHWESTERLY CORNER OF
MCBEAN PARKWAY AND COTTAGE CIRCLE DRIVE) -
APPROVAL OF FINAL MAP AND ACCEPTANCE OF OFFERS
OF DEDICATION

RECOMMENDED ACTION
1) City Council approve Tract Map No. 54271 (Condominiums, North Valencia 11 Annexation);
2) Accept on behalf of the public the offers of the right to restrict direct vehicular ingress and
egress to McBean Parkway, Riverside Lane, and Cottage Circle Drive; the easements for
sanitary sewers and sanitary sewer ingress and egress purposes; all sanitary sewers and
appurtenant structures; the easements for covered storm drain, appurtenant structures, ingress
and egress purposes; and the right to prohibit the erection of any structures within the open
space/common lots;
3) Make findings as follows: (a) that this project is consistent with the provisions of Sections
66474 and 66474.1 of the Subdivision Map Act and should be approved, and (b) that this
proposed subdivision, together with the provisions for this design and improvement, is
consistent with the General Plan required by Article 5 (commencing with Section 65300) of
Chapter 3 of Division 1 of the Government Code, or any specific plan adopted pursuant to
Article 8 (commencing with Section 65450) of Chapter 3 of Division 1 of the Government
Code;
4) Instruct the City Treasurer to endorse the Special Assessment Certificate on the face of Tract
Map No. 54271, which indicates that all special assessments levied by the City have been
paid;
5) Instruct the City Clerk to endorse the Certificate on the face of Tract Map No. 54271, which
embodies the approval of said map and the acceptance of the dedications shown thereon; and
6) Instruct the City Engineer to endorse the Agreement for Subdivision Improvements, which
provides for the manner in which various improvements described on Tract Map No. 54271,

and pursuant to the conditions for the final approval of said map for which security has been
posted, shall be constructed and completed.
BACKGROUND
Tract Map No. 54271 (Condominiums, North Valencia II Annexation) is the only phase of
Substantial Conformance Map Tract No. 54271, which was deemed to be in substantial
conformance with the principles and standards required by the Unified Development Code and
North Valencia H Specific Plan and approved by Planning staff on May 12, 2003. This phase
consisting of approximately 11.8 acres, is located at the southwesterly corner of
McBean Parkway and Cottage Circle Drive and is owned by Valencia H Associates, a Delaware
Limited Liability Company.
This map is a subdivision of Lot 8 of Tract Map No. 44831 and is creating 1 lot with
141 multi -family residences. Water rights have been secured for all lots. Trail requirements are
being met by the construction of a Class I bike trail along the eastern edge of San Francisquito
Creek, 8 -foot wide paseos on Cottage Circle Drive and Sunny Creek Lane, and a 10 -foot wide
paseo on Decoro Drive. The Quimby requirement has been fully satisfied by the dedication of
17.3 acres of public park, 1.1 acres of private park, and private recreation facilities on Tract Map
No. 44831, in accordance with the North Valencia II Development Agreement. Bridge and
Thoroughfare fees totaling $1,209,216 (per current Valencia District fees) shall be paid at
building permit issuance, as stipulated in the Conditions of Approval.
The conditions set by Planning staff have been met and fees have been paid as indicated on the
attached Fact Sheet. The map has been checked to the satisfaction of the City Engineer and is
ready for City Council approval and acceptance of the dedications.
ALTERNATIVE ACTIONS
Staff has not identified any alternative actions that would conform to requirements set forth in the
Subdivision Map Act,
FISCAL IMPACT
No new public streets are being dedicated to the City by this map. No impact will be made to the
City's street maintenance budget.
The developer is contributing the following amounts for the purposes described (refer to the
attached Fact Sheet for details):

facilities on Tract Map No. 44831, in accordance with the North Valencia II
Development Agreement.
School Fees: All appropriate school fees will be paid at the time of building permits.
