HomeMy WebLinkAbout2003-02-25 - ORDINANCES - QUIGLEY CYN ZC (2)ORDINANCE NO. 03-2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP (ZC 02-004) FOR QUIGLEY CANYON, THE 156.7 ACRE AREA GENERALLY LOCATED IN THE CITY OF SANTA CLARITA WITHIN THE COMMUNITY OF NEWHALL, NORTH OF SAN FERNANDO ROAD AND WEST OF SIERRA HIGHWAY WHEREAS, the City of Santa Clarita has proposed and initiated a Zone Change of approximately 156.7 acres of uninhabited land (Quigley Canyon), generally located within the community of Newhall, north of San Fernando Road and west of Sierra Highway; and WHEREAS, the City of Santa Clarita adopted the City of Santa Clarita General Plan on June 26, 1991 by City Council Resolution 91-98 and adopted the City of Santa Clarita Unified Development Code, including the City's zoning designations, on November 24, 1992, effective December 24, 1992; and WHEREAS, such zoning, as described in mapped in Exhibit A, would become effective 30 days after the second reading and designated upon the Zoning Map incorporated within and made a part of the City's Unified Development Code; and WHEREAS, the Planning Commission of the City of Santa Clarita conducted a public hearing on January 21, 2003, pursuant to applicable law, to consider the Zone Change for the City of Santa Clarita, and adopted Resolution No. P03-03, with the finding that the Negative Declaration was in compliance with the California Environmental Quality Act (CEQA), and recommending that the City Council approve General Plan Amendment No. 02-004, Zone Change No. 02-004 and the Negative Declaration prepared for the project; and WHEREAS, the City Council of the City of Santa Clarita set February 11, 2003 at the hour of 6:00 p.m., in the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita, California, as the time and place for a public hearing before said Council, and notice of said public hearing was given in the manner required by the Santa Clarita Municipal Code; and WHEREAS, at said public hearing, testimony was received, if any, for, and/or against the proposed annexation and prezone; and WHEREAS, at said public hearing, said General Plan Amendment and Zone Change were duly heard and considered; and WHEREAS, following said public hearing, the City Council of the City of Santa Clarita adopted a Resolution approving the General Plan Amendment and Negative Declaration prepared for this project with the finding that the General Plan Amendment was consistent with the goals and policies of the General Plan and the Negative Declaration was in compliance with the California Environmental Quality Act (CEQA). THEREFORE, be it resolved by the City Council of the City of Santa Clarita as follows: Ordinance No. 03-2 Page 2 SECTION 1. The City Council does hereby find and determine as follows: A. The Zone Change is a change from RE (Residential Estate), RVL (Residential Very Low), and RL (Residential Low) to OS (Open Space) and OS (Open Space) with a MOCA (Mineral/Oil Conservation Area) overlay in conformance with the City's General Plan as amended. B. Public participation and notification requirements pursuant to Sections 65090 and 65351 of the Government Code of the State of California were duly followed. SECTION 2. Based upon the testimony and other evidence, if any, received at the public hearing, and upon studies and investigations made by the Planning Commission and the City Council and on their behalf, the City Council further finds and determines that the project is consistent with the General Plan and complies with all other applicable requirements of State law and local ordinance. SECTION 3. In acting on the Zone Change application, the City Council has considered certain principles and standards, and finds and determines as follows: A. That the proposed Zone Change consists of 156.7 acres of uninhabited land generally located in the City of Santa Clarita within the community of Newhall, north of San Fernando Road and west of Sierra Highway. B. That the subject property is a proper location for the OS, and OS with a MOCA overlay zone, as identified in Exhibits A and B (General Plan Amendment and Zoning Map), consistent with the location of the OS and OS with a MOCA overlay designations on the City's General Plan Land Use Map, as amended. C. That the proposed zone change is consistent with the objectives of the City's Unified Development Code, the General Plan and development policies of the City. D. That a need for the Zone Change to the various City zones exists within the project area, and that public necessity, convenience, general welfare and good planning practice justify the changed zoning designations. SECTION 4. Based upon the foregoing, the City Council does hereby ordain that the application for a Zone Change is approved, and that the Official Zoning Map of the City of Santa Clarita is hereby amended to designate the subject property OS and OS with a MOCA overlay, as shown on Exhibit A. SECTION 5. This ordinance shall become effective at 12:01 a.m. on the thirty-first day after adoption. SECTION 6.
