HomeMy WebLinkAbout2003-02-11 - RESOLUTIONS - GPA PREZONE WHITNEY CYN (2)RESOLUTION NO. 03-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING A GENERAL PLAN LAND USE POLICY MAP AMENDMENT AND THE NEGATIVE DECLARATION FOR MASTER CASE NO. 02-345 TO AMEND THE GENERAL PLAN DESIGNATION (02-003) AND CHANGE THE PREZONING (02-003) OF A 545.27 ACRE UNINHABITED AREA KNOWN AS WHITNEY CANYON, GENERALLY LOCATED EAST OF THE EASTERN TERMINUS OF SAN FERNANDO ROAD, EAST OF STATE ROUTE 14, ADJACENT TO THE CITY OF SANTA CLARITA WHEREAS, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. The City Council does hereby find, determine, and declare: A. That the City has initiated General Plan Land Use Policy Map Amendment No. 02-003 to change the General Plan Land Use Policy Map designation of a 382.27 -acre portion of a 545.27 acre site, also known as Whitney Canyon, from RE (Residential Estate) to OS (Open Space), retaining the MOCA (Mineral/Oil Conservation Area) overlay; and B. That the City has initiated Zone Change No. 02-003 to change the prezoning of a 545.27 acre site, also known as Whitney Canyon, from RE (Residential Estate), with a MOCA (Mineral/Oil Conservation Area) to OS (Open Space) with a MOCA (Mineral/Oil Conservation Area) overlay and from OS (Open Space) with a MOCA (Mineral/Oil Conservation Area) to OS (Open Space) to allow for protection and preservation of the Whitney Canyon area; and C. That the Whitney Canyon site, located east of the eastern terminus of San Fernando Road, is predominately in a natural state and contains many oak trees. No development is proposed at this time. The proposed General Plan designation and prezoning reflects the existing and planned uses on-site; and D. That an Initial Study has been prepared for the project and that said study found that no adverse impact to the existing and future environmental resources of the area would result from the proposed General Plan Amendment and prezoning is consistent with the City's adopted General Plan. An environmental impact report was prepared and certified for the General Plan in June 1991 (SCH#90010683); and E. That the Initial Study found that the proposed General Plan Land Use Policy Map Amendment and Prezone would not have a significant adverse effect on the environment based on CEQA Section 21083.3 and a proposed Negative Declaration was posted and advertised on December 22, 2002 in accordance with the California Environmental Quality Act (CEQA); and Resolution No. 03-27 Page 2 F. That a proposed Negative Declaration was prepared for the project based on the Initial Study findings and the determination that the proposed project would not have a significant effect on the environment, would not impact resources protected by the California Department of Fish and Game, and that a finding of de Minimus impact on such resources was appropriate; and G. That the Planning Commission of the City of Santa Clarita conducted a public hearing on January 21, 2003, pursuant to applicable law, to consider the General Plan Amendment and Prezone, and adopted Resolution No. P03-02 with recommendation that the Negative Declaration was in compliance with the California Environmental Quality Act (CEQA), and recommending that the City Council approve Master Case No. 02-345 (the General Plan Amendment and Prezone) and the Negative Declaration prepared for the project; and H. That the City Council of the City of Santa Clarita conducted a public hearing on February 11, 2003, pursuant to applicable law, to consider the General Plan Amendment, Prezone, and Negative Declaration. SECTION 2. Based upon the testimony and other evidence received, the Council further finds as follows: A. That the proposed General Plan Amendment from RE (Residential Estate) with a MOCA (Mineral/Oil Conservation Area) overlay, and OS (Open Space) with a MOCA overlay to OS (Open Space) with a MOCA (Mineral/Oil Conservation Area) and OS (Open Space) is consistent with the following goals and policies of the City's General Plan: L 2.13 Encourage the preservation of the Angeles National Forest and the Los Padres National Forest as an open space reserve close to the urban interface, and as an important wildlife habitat and corridor. (L-28) L 7.6 Coordinate annexation activities with City growth management strategies. (L-34) H 1.2 Evaluate development proposals within the unincorporated portions of the planning area to ensure that development is consistent with both the City's and the County's land use plan. (H-59) ED 2.7 Seek a City Sphere of Influence consistent with the planning area of this General Plan. (ED -25) OS 4.11 Encourage open space linkage opportunities throughout the City and adjacent park and forest areas. (OS -29) OS 4.16 Seek park sites and open space areas having areas of natural scenic beauty which can be conserved and enjoyed by the public, as well as areas having recreational opportunities. (OS -29) Resolution No. 03-27 Page 3 B. Based upon the foregoing facts and findings, the City Council hereby determines the General Plan Amendment will help to meet the City's future recreational needs and will preserve the natural scenic beauty and biological resources in the area and is, therefore, consistent with several of the goals and policies contained in the City's General Plan. SECTION 3. Based upon the testimony and other evidence received, the Council further finds as follows: A. An Initial Study and a Negative Declaration for this project have been prepared in compliance with the California Environmental Quality Act (CEQA); B. The Initial Study has been circulated for review and comment by affected governmental agencies and the public, and all comments received, if any, have been considered. The Negative Declaration was posted and advertised on December 22, 2002 in accordance with CEQA. The public review period was open from December 22, 2002, through January 21, 2003; C. There is no substantial evidence that the project will have a significant effect on the environment. The Negative Declaration reflects the independent judgement of the City of Santa Clarita; —" D. The location of the documents and other material which constitutes the record of proceedings upon which the decision of the City Council is the Master Case 02-345 project file within the Planning and Building Services Department and is in the custody of the Director of Planning and Building Services; and E. Based upon the foregoing facts and findings, the City Council hereby determines that the Negative Declaration is in compliance with CEQA and that the proposed project will not have a significant impact on the environment. SECTION 4. Based upon the testimony and other evidence received, the Council further finds as follows: A. This project will not adversely affect the health, peace, comfort, or welfare of persons residing in the area, nor be materially detrimental to the use, enjoyment, or valuation of property in the vicinity of the project site, nor jeopardize, endanger, or otherwise constitute a menace to the public health, safety, or general welfare since the proposed General Plan designations and zoning are consistent with the City's General Plan land use designations. SECTION 5. The General Plan Land Use Policy Map Amendment, attached hereto as Exhibit A, and Negative Declaration for the project, attached hereto as Exhibit B, and by this reference incorporated herein, are hereby approved. The Director of Planning and Building Services is hereby directed to file the Negative Declaration with the County Clerk of the County of Los Angeles. Resolution No. 03-27 Page 4 SECTION 6. The City Clerk shall certify the adoption of this Resolution and shall give notice of this recommendation in the manner prescribed by the Municipal Code. Placenta Canyon Road is located to the north, the Angeles National Forest is to the east and residential & commercial uses are located west of SR14 in the City of Santa Clarita. DESCRIPTION OF THE PROJECT: A proposal for a General Plan Amendment and Prezone for an undeveloped site known as the Whitney Canyon Annexation located in unincorporated Los Angeles County. The project site is currently designated RE (Residential Estate) and OS (Open Space) with a MOCA (Mineral/Oil Conservation Area) overlay under the City of Santa Clarita General Plan. The proposed General Plan Amendment and Prezone is a change from the existing RE (Residential Estate) designation to OS (Open Space) on the western 382.27acre portion of the project site and removal of a MOCA (Mineral/Oil Conservation Area) overlay on the eastern 163 acre portion to allow for a sphere of influence amendment and annexation of the area. Based on the information contained in the Initial.
