A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, APPROVING THE
MITIGATED NEGATIVE DECLARATION/CATEGORICAL EXCLUSION
AND NATURAL ENVIRONMENT STUDY PREPARED FOR THE
SIERRA HIGHWAY BRIDGE(S) OVER THE
RAILROAD, PROJECT NO. S3009
WHEREAS, the City Council of the City of Santa Clarita (hereafter "City") hereby makes
the following findings of fact:
A. The City of Santa Clarita proposes to design and construct the rehabilitation and/or
replacement of the two existing bridges on Sierra Highway over the railroad while
providing adequate travel lane widths for motorists and cyclists, as well as standard
sidewalks for pedestrians in each direction.
B. This proposal is determined to be a project per the California Environmental Quality
Act (CEQA) and the National Environmental Protection Agency (NEPA) and has
been reviewed pursuant to their provisions. A Mitigated Negative
Declaration/Categorical Exclusion and Natural Environment Study have been
prepared for the project based on the findings of the Initial Study and the following
determinations: that although the project may have some affects on the environment,
there will not be a significant affect in this case because mitigation measures
described in the Mitigated Negative Declaration/Categorical Exclusion and Natural
Environment Study, on file, shall be added to the project; that the project will not
impact resources protected by the California Department of Fish and Game; and that a
finding of deminimus impact on such resources is appropriate, subject to
implementation of the mitigation measures on the project and per the appropriate
permits obtained as a result from the findings of the Mitigated Negative
Declaration/Categorical Exclusion and Natural Environment Study.
WHEREAS, based upon the above findings of fact, and upon studies and investigations
made on behalf of the City Council, the City Council further finds as follows:
A. Based on the Initial Study, the project does not have the potential to adversely affect
the environment or resources under the protection of the California Department of
Fish and Game, and no significant impacts are anticipated to result from the Sierra
Highway Bridge(s) over the Railroad, Project No. 53009.
_ B. A proposed Mitigated Negative Declaration/Categorical Exclusion and Natural
Environment Study were prepared for the project based on the Initial Study findings
and the determination that the proposed project would not have a significant affect on
the environment subject to the addition on the project of mitigation measures.
C. A notice of availability and a notice of intent to adopt a Mitigated Negative
Declaration was posted and advertised, and the proposed Mitigated Negative
Declaration was made available for a 30 -day review period beginning on
December 2, 2002, and ending on January 2, 2003, in compliance with the City's
adopted CEQA resolution.
WHEREAS, based upon the foregoing facts and findings, the City Council hereby
determines that:
A. The Sierra Highway Bridge(s) over the Railroad, Project No. S3009, is in compliance
with the National Environmental Protection Agency (NEPA), the California
Environmental Quality Act (CEQA), with State and local CEQA guidelines, and with
the City's General Plan and Zoning Ordinance.
B. The proposed Sierra Highway Bridge(s) over the Railroad project will not have a
significant affect upon the environment or on resources under the protection of the
California Department of Fish and Game.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Santa Clarita, California, as follows:
SECTION 1. The City Council hereby approves and adopts the Mitigated Negative
Declaration/Categorical Exclusion and Natural Environment Study prepared for the project.
SECTION 2. The City Council hereby directs that a Notice of Determination of
Negative Declaration be filed with the County of Los Angeles and the Governor's Office of
Planning and Research.
SECTION 3. The City Clerk shall certify the adoption of this Resolution.
SECTION 4. This Resolution shall be effective immediately upon its adoption.
