HomeMy WebLinkAbout2003-08-26 - RESOLUTIONS - UDC AMEND CEQA (2)RESOLUTION NO. 03-119 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, FINDING THAT THE AMENDMENT TO SECTIONS 17.07.010, 17.10.010, AND 17.15.020 OF THE CITY'S UNIFIED DEVELOPMENT CODE (UDC) REGARDING SECOND UNITS AND GUESTHOUSES AND THE ESTABLISHMENT OF A PROCESS BY WHICH SECOND UNIT AND GUESTHOUSE APPLICATIONS ARE TO BE REVIEWED AT STAFF LEVEL IS EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find, determine, and declare: A. The purpose of the proposal is to amend Section 17.15.020N of the Unified Development Code to provide for ministerial review of second unit applications, define second units and identify location criteria, development standards, and permitting requirements for second units consistent with Government Code Section 65852.2; and B. The purpose of the proposal is to amend Section 17.15.0200 of the Unified Development Code to define and identify location criteria, development standards, and permitting requirements for guesthouses; and C. The purpose of the proposal is to amend Section 17.07.010 of the Unified Development Code to provide amended definitions of 'second unit', 'guesthouse' and various other related terms and amend the permitted use chart in Section 17.13.010 to reflect the aforementioned amendments; and D. The purpose of the proposal is to add Section 17.03.110 to the Unified Development Code to establish an Administrative Permit process to process second unit and guesthouse applications, as well as other future projects deemed suitable for such review; and E. Public participation and notification requirements pursuant to Sections 65090, 65391, and 65854 of the Government Code of the Stat- of California were duly followed; and F. That the Planning Commission of the City of Santa Clarita conducted a public hearing on July 1, 2003, pursuant to applicable law, to consider the Amendment to the UDC, and adopted Resolution No. P03-022 with the finding that the project is exempt from the California Environmental Quality Act (CEQA), and recommending that the City Council approve UDC Amendment No. 03-001; and Resolution No. 03-119 Page 2 G. That the City Council of the City of Santa Clarita conducted a public hearing on August 26, 2003 at the hour of 6:00 p.m., in the City Council Chambers, 23920 Valencia Boulevard, Santa Clarita, California, pursuant to applicable law, to consider the UDC Amendment. SECTION 2. Based upon the testimony and other evidence received, the Council further finds as follows: A. Development standards which prohibit a second unit from exceeding the General Plan density of the parcel on which it is to be located ensures that General Plan density will not be exceeded; and B. As accessory structures and uses, guesthouses will not exceed the General Plan density of the parcels on which they are to be located; and C. The City Council, based upon the findings set forth above, hereby finds that the project is exempt from the provisions of the California Environmental Quality Act pursuant to Section 15305 (Minor Alterations in Land Use Limitations). SECTION 3. The UDC Amendment (UDC Amendment 03-001) is hereby found to be exempt from the California Environmental Quality Act. The Director of Planning and Building Services is hereby directed to file the Notice of Exemption with the County Clerk of the County of Los Angeles. SECTION 4. The City Clerk shall certify the adoption of this Resolution and shall give notice of this recommendation in the manner prescribed by the Municipal Code.
