Home My WebLink About2003-05-27 - RESOLUTIONS - VACATE EASEMENT PM 18789 19163 (2)RESOLUTION NO. 03-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, VACATING A PORTION OF SEWER EASEMENT, IN LOT 6 OF PARCEL MAP NO. 18789 AND IN LOT 1 OF PARCEL MAP NO. 19163; AND A PORTION OF STORM DRAIN EASEMENT IN LOT 5 OF PARCEL MAP NO. 18789 (IN THE VALENCIA INDUSTRIAL CENTER) IN THE CITY OF SANTA CLARITA WHEREAS, the sewer located in lot 6 of Parcel Map No. 18789 and lot 1 of Parcel Map No. 19163 has been relocated and a portion of the sewer easement is determined to be excessive, and the developer requests that the easement be vacated; and WHEREAS, the storm drain located in lot 5 of Parcel Map No. 18783 has been relocated and a portion of the storm drain easement is determined to be excessive, and the developer requests that the easement be vacated; and WHEREAS, the proposed vacation was reviewed and a notice of exemption for the vacation of the public service easement in compliance with the California Environmental Quality _ Act was certified, and such notice was filed with the County Clerk of the County of Los Angeles; and WHEREAS, under Chapter 4, Summary Vacation, of Part 3 of Division 9 of the Streets and Highways Code of the State of California, no public hearing is required and no public hearing was held. THEREFORE, pursuant to the provisions of Section 8334 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, California, does resolve, declare, determine, and order as follows: SECTION 1. That it is hereby found and determined that the portion of sewer easement, as described on Exhibit "A" and shown on Exhibit `B" attached hereto and the portion of storm drain easement, as described on Exhibit "C" and shown on Exhibit "D" attached hereto and incorporated herein by this reference, which real property located in the City of Santa Clarita, County of Los Angeles, State of California, is no longer needed for present or prospective use based on the fact that this sewer and storm drain easements are excess easements no longer required. SECTION 2. That within the portion of sewer and storm drain easement to be vacated, no public utility facilities exist that would be affected by the vacation. SECTION 3. That City staff of the City of Santa Clarita is instructed to record the certified original resolution in the office of the Registrar -Recorder of the County of Los Angeles, at which time the easements vacated will no longer be public service easements. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. PASSED, APPROVED AND ADOPTED this 27th day of May, 2003.
