HomeMy WebLinkAbout2004-05-25 - AGENDA REPORTS - ABATE FEE HART PONY AUTO CENTE (2)CONSENT CALENDAR DATE: SUBJECT: DEPARTMENT: Agenda Item: CITY OF SANTA CLARITA AGENDA REPORT City Manager Approval: Item to be presented by: May 25, 2004 Travis Lange r RESOLUTION INITIATING PROCEEDINGS FOR THE SITE SPECIFIC STORM DRAINAGE POLLUTION ABATEMENT FEE FOR THE HART -PONY AUTO CENTER, NORTH-WEST OF VALENCIA BOULEVARD AT AUTO CENTER DRIVE Field Services RECOMMENDED ACTION City Council adopt a resolution initiating proceedings for the Hart -Pony Auto Center Site Specific Storm Drainage Pollution Abatement Fee, and set a Public Hearing for May 25, 2004. BACKGROUND In November 1996, California voters passed Proposition 218 — The Right to Vote on Taxes Act. As a result, the City must conduct a majority protest hearing and a ballot election before imposing a Site Specific Storm Drainage Pollution Abatement Fee on the associated parcel(s). Pursuant to Proposition 218, the property owner, Newhall Land and Farming Company, has submitted a written waiver requesting that the time requirements for initiating proceedings and conducting the protest and election public hearings be compressed to shorten the process. Typically, Proposition 218 requires that if a new fee is imposed on a property, a majority protest hearing shall be held not less than 45 days after the mailing of the public notice. If no majority protest occurs, the City shall mail a public notice of the proposed fee with a ballot to all property owners, and hold a public hearing not less than 45 days after the mailing of the public notice and ballot. If after the closing of the public hearing property owners elect to impose a fee, the City Council may adopt a resolution canvassing ballots and imposing the site specific storm drainage pollution abatement fee. At the request of the property owner, and pursuant to Proposition 218, the time requirements have been compressed into a single public hearing. Adopted:k_'A oC/ - ss In addition, the Site Specific Storm Drainage Pollution Abatement Fee will include an annual inflation adjustment in accordance with the Consumer Price Index (CPI) for Los Angeles, Long Beach, and Anaheim, for April of each year. ALTERNATIVE ACTIONS No other alternative actions have been identified by staff. FISCAL IMPACT The anticipated annual costs associated with the maintenance for the additional water quality facility located in the Hart -Pony Auto Center is $6,000. Based upon the proposed development of 4 parcels, the annual levy will be $1,500 per parcel. This will result in anticipated additional revenues in the Stormwater Utility Fund (Fund 456) in the amount of $6,000 to cover the costs of the additional maintenance. The annual levy of $1,500 per parcel is subject to bi-annual review and adjustment based on actual expenditures. ATTACHMENTS Resolution Stormwater Fee Report ATTACHMENT TO RESOLUTION HART -PONY AUTO CENTER, TRACT 51931-06, NORTH-WEST OF VALENCIA BOULEVARD AT AUTO CENTER COURT STORMWATER FEE REPORT The following annual budget for maintenance includes monthly inspection and debris removal for clean-out of four outlets to the Santa Clara River. The Site Specific Storm Drainage Pollution Abatement Fee will include an annual inflation adjustment in accordance with the Consumer Price Index (CPI) for Los Angeles, Long Beach, and Anaheim, for April of each year. Outlets into Santa Clara River The sediment clean-out cost for pipe outlets into the Creek is assumed to be $1,500 per year for 48 inch and smaller pipe outlets. There arm total of 4 pipe outlets into the river in Tract 51931-06, all less than 48 inches. None of these pipes are expected to carry significant amounts of debris in a 50 year storm event and the treatment devices for the inlets to the pipes will be maintained as prescribed in the individual parcel owners Standard Urban Storm Water Mitigation Plan (SUSMP). The City of Santa Clarita will maintain from the outlet in the River to the first manhole. The County of Los Angeles will maintain the pipes from the first manhole to the inlets by way of catch basins on the individual parcels.
