FIRST READING OF AN ORDINANCE ADOPTING THE LOS
ANGELES COUNTY PUBLIC HEALTH CODE

RECOMMENDED ACTION
City Council introduce and pass to second reading an ordinance entitled, "AN ORDINANCE OF
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADOPTING
THE LOS ANGELES COUNTY PUBLIC HEALTH CODE AND ADDING CHAPTER 9.02
TO THE SANTA CLARITA MUNICIPAL CODE."
BACKGROUND
The County of Los Angeles, under agreement with the City, enforces public health related
regulations within the City of Santa Clarita. Recently, it was noted that the City's municipal code
does not include provisions adopting the most current edition of the Los Angeles County Public
Health Code. The attached letter from the County's Department of Health Services outlines a
request that the City adopt, by reference, the County Public Health Code to properly codify this
document as part of the Santa Clarita Municipal Code.
Without the codification of the County Public Health Code, the County's Department of Public
Health cannot adequately enforce the provisions of this code within the City of Santa Clarita.
These provisions pertain to businesses such as self service laundry facilities, owners of
swimming pools, owners of rental properties, wholesale food manufacturing facilities, and water
and sewage treatment facilities.
In accordance with the City -County agreement, the City is required to adopt the latest Public
Health Code provisions in order for the City to receive consistent and effective enforcement
services by the County. This ordinance will meet the terms of the City -County agreement and
allow for consistent and uniform enforcement of the County Public Health Code within the City
of Santa Clarita.
ALTERNATIVE ACTIONS
Develop and adopt separate public health provisions and develop a City public health
enforcement program.
FISCAL IMPACT
No fiscal impact is anticipated as a result of the passage of this ordinance. All costs are currently
provided for under the City's agreement with the County. No new fees or costs would be created
as a result of this item.

ADOPTION OF PUBLIC HEALTH CODE AND RESOLUTION OF ENFORCEMENT
Environmental Health provides services to the cities in Los Angeles County, including the City
of Santa Clarita. These services are authorized through Environmental Health Inspection
Services Agreements; City Resolutions allowing the Health Officer to enforce orders, quarantine
regulations, rules and other statutes relating to the public health; and by local adoption of the
County Public Health Code.
While conducting a recent review of your on-line municipal code, it was found that the City has
not currently adopted the County Public Health Code, with the exception of ordinance 97-0071,
the Restaurant Grading Ordinance. The City had previously adopted the County Public Health
Code when they adopted the entire County of Los Angeles Municipal Code through ordinance
88-37. This ordinance was to remain in effect until the City adopted any ordinance which
superceded any section of the Los Angeles County Municipal Code. It now appears that the Los
Angeles County Municipal Code has been superceded, without the City re -adopting the
provisions of the County Public Health Code.
Without the codification of the County Public Health Code, our department would be seriously
hindered in our ability to conduct inspections of, or issue notices of correction to self service
laundries, owners of swimming pools, owners of rental properties, wholesale food manufacturing
facilities, and water and sewage treitment facilities . Therefore, we request that the City of Santa
Clarita adopt by reference the County Public Health Code within the City's municipal code.
In addition to the adoption of the County Public Health Code, the County must have on file a

copy of the City's resolution allowing the Health Officer to enforce laws within the City. Please
forward a copy of this resolution to me, for inclusion in your City's file. If the City has not
passed such a resolution, I have included a sample format for your reference.
