T3009; FEDERAL PROJECT NO. STPLHSR-5450(021) — AWARD CONSTRUCTION CONTRACT AND APPROVAL OF PROJECT PLANS AND SPECIFICATIONS DEPARTMENT: Transportation and Engineering Services RECOMMENDED ACTION City Council award the construction contract for the Lost Canyon Road Pedestrian Bridge and Sidewalk Improvements, Project No. T3009, to E.A. Mendoza, Inc. in the amount of $134,100.00, and authorize a 15 percent contingency in the amount of $20,115.00; approve the project plans and specifications; and authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND On June 11, 2002, City Council awarded the design services contract for the Lost Canyon Road Pedestrian Bridge and Sidewalk Improvements, Project No. T3009, to Willdan. The design for the Lost Canyon Road Pedestrian Bridge and Sidewalk Improvements was completed in July 2003. On December 11, 2003, the City Clerk's office received bids for the project (Exhibit "A," Bid Results). E.A. Mendoza, Inc. submitted the lowest responsive bid with a minor irregularity in the amount of $134,100.00. In addition, staff recommends a 15 percent contingency in the amount of $20,115.00. Staff recommends waiving the minor irregularity of E.A. Mendoza not inking the name of the supplier on the "designation of subcontractors" sheet, page 8 of the project specifications, because they submitted it in the bid proposal at the time of the bid opening. Staff considers this as a minor omission by E.A. Mendoza, since this would not affect changes to the final submitted bid amount of $134,100.00. E.A. Mendoza informed the City after the bid opening that they would use Excel Bridge Manufacturing Co. as their prime bridge supplier even though it was not listed in the "designation of subcontractors" sheet. According to Section 4104 of the Public Contract Code, the prime contractor is required to name each of the subcontractors who will perform work or labor, or render service in or about the construction of the improvements, in excess of one-half of one percent of the prime contractor's total bid or ten thousand dollars ($10,000.00), whichever is greater. E.A. Mendoza did not have names of subcontractors since they are performing the work in-house with their own construction crew. On October 20, 2003, Caltrans issued a letter of authorization to proceed with construction, allowing the City to proceed with the bid advertisement and construction of the bridge and concrete sidewalk improvements connecting to the elementary schools. Through a competitive grant process, the City was successful in securing $405,000.00 in federal funds through the Safe Routes to School Program for the different phases leading to the construction of the pedestrian bridge and sidewalk. The total estimated cost of the project, including the design services and construction contract, is $450,000.00, including the local match of $45,000.00, or 10 percent of the total federal fund allocation. The scope of work for the project consists of the construction of a prefabricated pedestrian steel truss bridge parallel to, but independent from, the existing bridge on Lost Canyon Road over the Sand Canyon Wash, and a sidewalk for the safe route to school improvements along the south side of the Lost Canyon Bridge. Because the bridge is prefabricated, it will be designed and manufactured in -shop. The contractor will be responsible for ordering the bridge after the contract documents are fully executed. Construction is scheduled to commence as soon as the prefabricated steel truss bridge is shipped to the job site, with the anticipation of completing the construction within 40 working days from the effective date of the Notice to Proceed. Substantial constraints and controls have been established in the construction documents to reduce potential impacts on local elementary schools and homeowners during the construction phase. The contractor's activities in the street shall be confined to avoid peak school traffic flow on weekdays during the school year. Traffic control will include all necessary signing and striping, traffic cones, delineators, reflectors, flagmen, and traffic barriers, if needed, for safe handling of pedestrian and vehicular traffic. Staff will appoint an inspector to ensure proper work performance by the contractor, as well as handling daily field issues. During the construction, staff will appoint a Labor Compliance Officer to review certified payrolls to be submitted by the prime contractor and conduct field interviews with the contractor's crew in conformance with the State Prevailing Wage Rate. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT The project is federally funded via Federal Transportation Safety funds, which are available for use for local school pedestrian safety mitigation. Sufficient funds would need to be budgeted in the amount of $154,215.00, including the local match funds in the amount of $15,421.00 for Fiscal Year 2003/2004 as follows: FUNDING SOURCE ACCOUNT NO.
