Pulskamp DATE: January 13, 2004 SUBJECT: PRESERVATION OF 493 ACRES OF REAL PROPERTY DEPARTMENT: City Manager RECOMMENDED ACTION 1. City Council authorize the City Manager to sign all required documentation to authorize the purchase of a Promissory Note and Deed of Trust secured by 493 acres of real property located outside of the City's eastern boundary (Assessor's Parcel Numbers: 3210-013-033; 3210-013-043; 3210-014-025; 3210-014-027; 3210-014-028; 3210-019-006; and 3120-019-007). 2. City Council approve Resolution adopting the Notice of Exemption. 3. City Council appropriate $475,000 from the Public Facilities Replacement Fund fund balance to account 604-9501, increase estimated revenues in account 001-6810, and appropriate $475,000 to account 2100-8620 for the purchase. BACKGROUND On December 10, 2003 the City entered into negotiations to purchase a Promissory Note and Deed of Trust secured by 493 acres of real property, located outside of the City's eastern boundary, from The Clare Schweitzer Trust (Assessor's Parcel Numbers: 3210-013-033; 3210 -013-043;3210-014-025;3210-014-027;3210-014-028;3210-019-006; and 3120-019-007). Purchase of this Deed and Note will enhance the City's continuous efforts to preserve this location in its existing natural condition. The cost to purchase the Note and Deed will total $475,000. In order to secure the interest in real property, a Notice of Exemption must be approved by the City Council. Staff has reviewed this purchase/project and found that it was exempt from CEQA Adoptee ' V r,7 provisions pursuant to Class 25, Section 15325 regarding the transfer of interest in land to preserve in existing natural condition. In addition, the Notice of Determination is consistent with the goals and policies of the City's General Plan, and complies with all other applicable requirements of State law and local guidelines. ALTERNATIVE ACTIONS 1. City Council may direct staff to cease purchase of the Promissory Note and Deed of Trust. 2. Other actions as determined by the City Council. FISCALIMPACT The Public Facilities Replacement Fund has an available fund balance of $7.1 million. Approval of this item will leave a remaining balance of $6.625 million ($7.1 million - $475,000 = $6.625 million).
