F3009 - PROJECT ACCEPTANCE DEPARTMENT: Transportation and Engineering Services RECOMMENDED ACTION 1. City Council accept the work performed by Fedcon General Contractors, Inc., Project No. F3009; direct the City Clerk to file the attached Notice of Completion; and direct staff to release the retention balance 35 days after the Notice of Completion is recorded, provided no stop notices, as provided by law, have been filed; 2. Increase estimated revenues in Account No. 001-6714 by $257,025.00 from Centre Pointe Business Park pursuant to the Development Agreement for the construction of an overflow parking lot within Los Angeles Department of Water and Power's right-of-way; Appropriate $257,025.00 to Account No. F3009001-8001 to pay Fedcon General Contractors, Inc. for the construction of the overflow parking lot; and 4. Transfer $140,000.00 from the Contingency Fund, Account No. 2250-7401, to Account No. F3009001-8001 for the existing Sports Complex parking lot rehabilitation and temporary parking lot. BACKGROUND On March 26, 2002, the City Council awarded a contract to Fedcon General Contractors, Inc. to construct the Aquatics Center project. This project provided the aquatic elements that were identified in the Santa Cladta Sports Complex Master Plan established during Fiscal Year 1998/1999. The development consists of a 50 -meter competition pool with bleacher seating, a 25 -meter pool with a competition diving well, a recreational pool, a building to house aquatics staff and serve as a visitor center, a concession building with additional restrooms, site amenities including parking and access roads, connecting walkways, signage and landscaping, a temporary parking lot constructed on the future gymnasium pad area, and an overflow parking lot within the Department of Water and Power's right-of-way. In October 2000, a transfer of $354,225.00 from the Aquatics Center project to the Activity Center project was authorized to fill a gap in that adjacent project's funding. These funds were not replaced in the hope that the Aquatics Center could be completed without them. As a result of several changes during construction that greatly enhance the facility's value, an additional $140,000.00 is requested to close out the project. It should be noted that several amenities that were originally removed from the contract (timing systems and shade structures) were eventually returned to the project. This was made possible due to the fact that fewer true "contingency" (unplanned or unforeseen circumstances) expenses were encountered, and additional funding was obtained during construction (additional landscape and flume slide). In November 2003, the High Desert Branch of the American Public Works Association recognized the Santa Clarita Aquatics Center as its Public Works Project of the Year. Staff was honored that this professional organization recognized not only the quality of this project, but also the benefit that the Aquatics Center will provide to the community for years to come. The Aquatics Center was completed to the satisfaction of the City Engineer on April 20, 2004. ALTERNATIVE ACTION Other action as determined by the City Council. FISCAL IMPACT The ongoing operating costs have been budgeted as part of the City's operating budget. The current balance in the Contingency Fund is $615,740.00.
