AWARD CONSTRUCTION CONTRACT

RECOMMENDED ACTION
City Council award the construction contract for the Sand Canyon Swale Removal, Project
No. M3005, to PALP Inc. dba Excel Paving Company in the amount of $118,810.00, and
authorize a 20 percent contingency expenditure in the amount of $23,700.00; approve the plans
and specifications; and authorize the City Manager or designee to execute all documents, subject
to City Attorney approval.
The scope of work for the Sand Canyon Swale Removal project consists of removing and
backfilling existing asphalt swales located along Sand Canyon Road between Road Runner Road
and Comet Way. This project will provide a dirt shoulder along the west side of Sand Canyon
Road within the project limits. This is consistent with the future trail use which is planned along
this segment. The recent construction of the Live Oak Springs Canyon Road storm drain has
made this project possible by facilitating drainage in the area of the swales. The City received a
letter dated January 31, 2002, from Supervisor Michael Antonovich, Los Angeles County Fifth
District, agreeing to provide the City with financial assistance equal to one-half of the project
cost of swale removal, up to a maximum of $100,000.00.
On May 18, 2004, the City Clerk's office received the following bids for the project:

The engineer's estimate, including the 20 percent contingency, for the Sand Canyon Swale
Removal project is $150,000.00. The lowest responsive bid was submitted by PALP, Inc. dba
Excel Paving Company in the amount of $118,810.00. After reviewing the bid summary, staff
verified the apparent low bidder's contractor's license, sureties company, and project references.
Based on the investigation, staff recommends awarding the construction contract to PALP Inc.
dba Excel Paving Company, the lowest responsive bidder, in the amount of $118,810.00.
Substantial constraints and controls have been established in the construction documents to
reduce potential impacts on local traffic and homeowners during the construction phase.
Construction is scheduled to start in July 2004, and the contractor will be given 25 working days
to complete all work after the date of construction commencement. Staff has already assigned
the project manager and inspector to ensure proper work performance by the contractor, as well
as handling daily field issues.

FISCAL IMPACT
Funds for this project have been approved and budgeted in Account Nos. M3005001 and
M3005455 for Fiscal Year 2003-04 in the amount of $142,510.00. These funds are available in
