RECOMMENDED ACTION
City Council accept the work performed by Padilla Paving on the Scherzinger Lane Street
Improvements, Project No. S3013; direct the City Clerk to file the attached Notice of
Completion; and direct staff to release the 10 percent retention 35 days after the Notice of
Completion is recorded, provided no stop notices have been filed, as provided by law.
BACKGROUND
On August 26, 2003, the City awarded the sewer construction project to Padilla Paving for the
Scherzinger Lane Street Improvements project. A contract was entered into for the purpose of
removing the existing pavement and base, construction of asphalt concrete paving, aggregate
base placement and compaction, constructing the sidewalk, curb and gutter, installing an 8 -inch
main line sewer with 4 -inch house laterals (including saw cutting and removal of pavement,
trenching, bedding, laying VCP pipe, backfill and compaction, pavement, and repairs and
replacement of damaged landscaping), reconstructing the drainage inlet, and installing the
streetlight conduit.
During the construction of the main line sewer, Padilla Paving requested to be relieved of the
street construction portion of the contract due to unexpected delays by utility companies. These
delays were beyond the City's and contractor's control. Staff determined that it would be
beneficial to allow the contractor's request, and City Council approval was given to bid the street
portion of the project out separately, upon completion of the sewer.

A Settlement Agreement was reached between the City and the contractor, Padilla Paving Co.,
that limited the work to be done and the cost associated with such work. The work to be done as
described in the Settlement Agreement has been completed on time and at the agreed cost of
$189,954.25, according to the terms of the Agreement. The sewer has been inspected by the City
and the Los Angeles County Sanitation District. The work has been completed in accordance
with the standards set forth in the contract documents and is ready for acceptance.
The remaining portion of the work was awarded to Security Paving at the March 23, 2004 City
Council meeting.
Community Development Block Grant (CDBG) Census Block data identifies Scherzinger Lane
as an eligible area for the expenditure of CDBG funds. The funding for this improvement is part
of the City's annual entitlement from CDBG, and a portion of funding is included in the
Fiscal Year 2003-2004 Capital Improvement Program funded projects.
ALTERNATIVE ACTIONS
Other action as determined by the City Council.
FISCAL IMPACT
Community Development Block Grant funds for the entire project in the amount of $582,810.00,
were budgeted in Account No. S3013104. The total cost for this portion of the work was
$189,954.25.
