Bertoni DATE: March 9, 2004 SUBJECT: TRANSIT MIXED CONCRETE (TMC) BUDGET AND AGREEMENT WITH WILLDAN ASSOCIATES FOR ENVIRONMENTAL SERVICES DEPARTMENT: Planning and Building Services RECOMMENDED ACTION Authorize a transfer in the amount of $50,000 from the TMC Reserve (Account #2250-7402) and appropriate an additional $241,371 from the Council Contingency Fund (Account #2250-7401) into the TMC operating account (Account #3110-8110 Project 06.00) for a total appropriation of $291,371. Authorize the City Manager, or designee to execute a new professional services agreement with Willdan Associates, for environmental services related to the TMC project, for an amount not to exceed $50,000, subject to City Attorney approval. BACKGROUND Currently, the balance of the TMC operating budget totals $70,629. However, based on the level of current activity, staff estimates that an additional $291,371 will be needed to continue the opposition strategy through June 2004. Thus, this forecast will require the transfer of TMC Reserves ($50,000) and City Council Contingency ($241,371) to the TMC operating account. The following is a summary of anticipated expenditures by category and the activities expected to take place through June 2004: TMC FORECAST SUMMARY (Through June 2004) CATEGORY ESTIMATE Legal Strategy $286,000 Legislative Advocacy $25,000 Environmental $21,000 Community Outreach $30,000 TOTAL FORECAST $362,000 TOTAL OPERATIONAL BUDGET BALANCE $70,629 TOTAL FUNDS NEEDED $291,371 Legal Strategy ($286,000) It is estimated that the legal strategy will cost $286,000 to implement through June 2004. This estimate considers our effort to address the Cemex vs. County of Los Angeles settlement, further actions in the City vs. U.S. Department of Interior lawsuit, attorney client privilege meetings, and meetings with various government agencies. Legislative Advocacy ($25,000) It is estimated that an additional $25,000 will be required to continue legislative advocacy efforts at the County and State level and to continue supporting Senator Barbara Boxer and Congressman Howard "Buck" McKeon' s federal legislation to keep mining in Soledad Canyon at historical levels. The City currently maintains agreements with Afriat Consulting Group and Jamison and Sullivan for legislative advocacy efforts. Environmental Research ($21,000) An estimated $21,000 will be needed to continue any necessary environmental research to support the City's legal strategy through June 2004. The City has been contracting with Willdan Associates since 1999 for environmental support on the TMC opposition effort. On September 10, 2002, the City Council approved amending the City's original agreement with Willdan to extend the contract amount for an additional $45,000, which brought the contract total to $221,000. The $45,000 appropriated by the City Council in September 2002 has been expended. Staff is requesting that the Council approve a new agreement with Willdan not to exceed $50,000, which will bring the contract total to $271,000. Community Outreach ($30,000) Staff estimates that an additional $30,000 will be required to implement an outreach strategy. This could include the modification or printing of additional TMC postcards and the development of television/print ads. ALTERNAT VE ACTIONS 1. Council not approve appropriation of additional funds and execution of new agreement with Willdan Associates. 2. Other action as determined by the City Council. FISCAL IMPACT The Council Contingency Fund currently has a balance of $857,111. If the City Council approves this request, the Council Contingency fund will have a remaining balance of $615,740. This appropriation will also leave a zero balance in the TMC Reserve account.
