HomeMy WebLinkAbout2004-05-25 - RESOLUTIONS - APPROVE GP AMEND 99-04 (2)RESOLUTION NO. 04-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT NO. 99-04 (MASTER CASE NO. 99-335) AMENDING THE HOUSING ELEMENT OF THE GENERAL PLAN THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: FINDINGS OF FACT. The City Council of the City of Santa Clarita (hereafter "City"), hereby makes the following findings of fact: A. The proposed General Plan Amendment 99-04 would amend the Housing Element, including the identification of housing policies, needs, quantified goals, constraints, and programs. The proposed changes will be implemented throughout the City of Santa Clarita planning area. B. On June 25, 1991, the City Council adopted Resolution No. 91-88, approving and certifying the Environmental Impact Report for the General Plan and adopting the General Plan for the City of Santa Clarita. C. On December 8, 1992, the City of Santa Clarita City Council adopted Resolution No. 92-226, amending the Housing Element of the General Plan and adopting the Negative Declaration. D. On March 14, 1995, the City Council for the City of Santa Clarita adopted Resolution No. 95-21, approving Master Case No. 95-015, General Plan Amendment 95-01, amending Resolution No. 92-226 and amending the Housing Element of the General Plan for the City of Santa Clarita. E. The City of Santa Clarita initiated the Housing Element update on September 1, 1999. F. On October 2, 2001, the Planning Commission of the City of Santa Clarita conducted a duly noticed public hearing on proposed General Plan Amendment No. 99-04. The public hearing was held at 7:00 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard, Santa Clarita. G. The Planning Commission fully considered the Draft Negative Declaration and Initial Study prepared for General Plan Amendment No. 99-04 and all testimony and evidence regarding proposed General Plan Amendment No. 99-04 updating the Housing Element and they recommended to the City Council to adopt the Negative Declaration for the proposed project and approve Master Case 99-335 consisting of General Plan Amendment 99-04. H. On November 13, 2001, the City Council of the City of Santa Clarita conducted a duly noticed public hearing on proposed General Plan Amendment No. 99-04. The Resolution No. 04-66 Page 2 public hearing was held at 6:00 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard, Santa Clarita. I. The City Council fully considered the Draft Negative Declaration and Initial Study prepared for General Plan Amendment No. 99-04 and all testimony and evidence regarding proposed General Plan Amendment No. 99-04 updating the Housing Element and adopted the Negative Declaration for the proposed project and approved Master Case 99-335 consisting of General Plan Amendment 99-04. J. The Element was forwarded to HCD for review. The amended Element was returned by HCD on February 14, 2002 with comments. The document was revised pursuant to HCD's comments. K. On August 5, 2003, the Planning Commission of the City of Santa Clarita conducted a duly noticed public hearing on proposed General Plan Amendment No. 99-04. The Planning Commission fully considered the Negative Declaration and Initial Study previously prepared for General Plan Amendment No. 99-004 and all testimony and evidence regarding proposed General Plan Amendment No. 99-004 revising and updating the Housing Element including map exhibits, tables, and planning goals & policies and found that the proposed Housing Element General Plan Amendment is consistent with Government Code Sections 65302 (g), 65581, and 65583. L. The Planning Commission recommended that the City Council of the City of Santa Clarita approve the General Plan Housing Element Amendment. M. On August 26, 2003, after reviewing the draft Element, the City Council voted unanimously to direct staff to forward the revised Element to the HCD for review. In a letter dated January 8, 2004, HCD concludes that the revised element will be in full compliance with State law once it is adopted by the City Council and submitted to HCD. N. On May 25, 2004, the City Council of the City of Santa Clarita conducted a duly noticed public hearing on proposed General Plan Amendment No. 99-04. The public hearing was held at 6:00 p.m. at City Hall, Council Chambers, 23920 Valencia Boulevard, Santa Clarita. O. The City Council fully considered all testimony and evidence regarding proposed General Plan Amendment No. 99-04 updating the Housing Element. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS. Based upon the above findings of fact, and upon studies and investigations made on behalf of the City Council, the City Council further finds the following California Environmental Quality Act findings: A. A Draft Negative Declaration and Initial Study for this project was prepared and circulated from August 28, 2001 through October 2, 2001 in compliance with the California Environmental Quality Act and adopted as required by that Act; and Resolution No. 04-66 Page 3 B. Said study found that no adverse impact to the existing and future environmental resources of the area would result from the proposal; and C. The City Council hereby finds that the proposed revisions are consistent with the conclusions of the initial study. Therefore, no additional environmental review is required. GENERAL PLAN AMENDMENT FINDINGS. Based upon the above findings of fact, and upon studies and investigations made on behalf of the City Council, the City Council further finds the following General Plan findings: A. The proposed Housing Element General Plan Amendment is consistent with Government Code Section 65583 which states that a Housing Element is a mandatory element of the General Plan and shall consist of an identification and analysis of existing and projected housing needs and a statement of goals, policies, quantified objectives, financial resources, and scheduled programs for the preservation, improvement, and development of housing. B. The proposed General Plan Amendment is necessary to update the Housing Element in order to reflect the adequate sites for housing, including rental housing, factory - built housing, and mobile homes, and shall make adequate provision for the eristing and projected needs of all economic segments of the community. C. California State law requires that each City adopt a General Plan. The proposed Housing Element Amendment is consistent with the City of Santa Clarita General Plan and the existing elements contained within the document. D. The Housing Element describes existing and project housing inventories and opportunities for additional housing within the planning area. E. The Housing Element determines the extent of housing problems in the community and planning area. F. The Housing Element describes methods for solving housing deficiencies and providing the City and its planning area with sufficient housing at all income levels. G. The information which is the subject of this General Plan amendment is consistent will all other provisions of the Housing Element. H. The Housing Element as amended, remains consistent with all elements of the General Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Clarita, California, as follows: SECTION 1. The proposed revisions to the General Plan Housing element update are consistent with the conclusions of the initial study adopted by the City Council on November 13, 2001. Resolution No. 04-66 Page 4 SECTION 2. The City Council hereby adopts the General Plan Housing Element Amendment (Master Case 99-335, General Plan Amendment 99-04) as incorporated herein by this reference. SECTION 3. The City Clerk shall certify to the adoption of this Resolution and certify this record to be a full, complete, and correct copy of the action taken. SECTION 5.
