HomeMy WebLinkAbout2004-01-13 - RESOLUTIONS - NEWHALL CMTY CENTER PROJ (4)RESOLUTION NO. 04-1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADOPTING THE MITIGATED NEGATIVE DECLARATION AND APPROVING THE APPLICATION FOR GRANT FUNDS FOR THE URBAN PARK ACT OF 2001 PROGRAM UNDER THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND COASTAL PROTECTION ACT OF 2002 FOR THE NEWHALL COMMUNITY CENTER PROJECT WHEREAS, the people of the State of California have enacted the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002, which provides funds to the State of California for grants to eligible Applicants; and WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration of the Urban Park Act of 2001 Program and the Grant Project shown above within the State, setting up necessary procedures; and WHEREAS, said procedures established by the California Department of Parks and Recreation require the Applicant's Governing Body to certify by resolution the approval of the Applicant before submission of said application to the State; and WHEREAS, the Applicant will enter into a Contract with the State of California for the Project; and WHEREAS, the City Council, has considered the proposed Mitigated Negative Declaration and, based upon the findings set forth below, hereby finds that Mitigated Negative Declaration for this project has been prepared in compliance with the California Environmental Quality Act (CEQA): A. An Initial Study and a Negative Declaration for this project have been prepared in compliance with CEQA. B. The Initial Study has been circulated for review and comment by affected governmental agencies and the public, and all comments received, if any, have been considered. The document was posted and advertised on December 15, 2003, in accordance with CEQA. The public review period was open from December 10, 2003, through January 13, 2004. C. There is no substantial evidence that the project will have a significant effect on the environment. The Mitigated Negative Declaration reflects the independent judgment of the City of Santa Clarita. D. The location of the documents and other material which constitutes the record of proceedings upon which the decision of the City Council is the Master Case 03-238 Resolution No. 04-1 Page 2 project file within the Planning and Building Services Department and is in the custody of the Director of Planning and Building Services. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. Adopts the Mitigated Negative Declaration for the Newhall Community Center located along Market Street; and SECTION 2. Approves the filing of an Application for local assistance funds from the Urban Park Act of 2001 Program under the California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Act of 2002; and SECTION 3. Certifies that the Applicant has or will have sufficient funds to operate and maintain the Project; and SECTION 4. Certifies that the Applicant has reviewed, understands, and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and SECTION 5. Certifies that the Grantee has or will have available, prior to commencement of any work on the Project, the proportional Match, and SECTION 6. Certifies that the Project conforms to the recreation element of any applicable city or county general plan; and SECTION 7. Authorizes the City Manager, or designee, as agent of the City of Santa Clarita to conduct all negotiations, execute and submit all documents including, but not limited to, applications, agreements, payment request and so on, which may be necessary for the completion of Project. SECTION 8. The City Clerk shall certify to the adoption of the Resolution. PASSED, APPROVED AND ADOPTED this 13`" day of January, 2004.
