HomeMy WebLinkAbout2004-01-13 - RESOLUTIONS - NEWHALL COUNTY WATER DIST RESO (2)RESOLUTION NO. 04-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, OPPOSING PROPOSED NEWHALL COUNTY WATER DISTRICT RESOLUTION 2004-3 RELATING TO URBAN WATER MANAGEMENT PLAN 2000 WHEREAS, Newhall County Water District (NCWD) is a public agency providing water at retail to residents of the Santa Clarita Valley; and WHEREAS, portions of the NCWD service area are located within the boundaries of the City of Santa Clarita; and WHEREAS, the NCWD participated with the Castaic Lake Water Agency and water retailers in the development of Urban Water Management Plan 2000; and WHEREAS, the City of Santa Clarita relies upon Urban Water Management Plan 2000 as a resource document in the review of development projects to determine the future availability of water prior to approving various development applications; and WHEREAS, the Urban Water Management Plan will be updated in 2005 and be reflective of new water programs and local considerations which have developed during the period since the adoption of the current plan; and WHEREAS, NCWD Resolution 2004-3, as considered by the NCWD Board of Directors on January 8, 2004 and continued for consideration at a future date, is in substantial conflict with, and has the practical effect of negating, Urban Water Management Plan 2000; and WHEREAS, Castaic Lake Water Agency has expressed significant disagreement with a number of factual assertions, data interpretations, and conclusions contained within proposed NCWD Resolution 2004-3; and WHEREAS, the City of Santa Clarita has made binding decisions regarding development applications resulting in vesting of property rights and continues to process various development applications which depend upon the reliability of Urban Water Management Plan 2000. NOW, THEREFORE, the City Council of the City of Santa Clarita, meeting in regular session on January 13, 2004 does hereby resolve as follows: SECTION 1. The City Council is opposed to the adoption of NCWD Resolution 2004-3; and '— SECTION 2. Any legally valid changes and/or modifications of Urban Water Management Plan 2000 must be consistent with the procedures outlined in the Urban Water Management Planning Act; and Resolution No. 04-10 Page 2 SECTION 3. An extensive and inclusive public participation process, which includes the City of Santa Clarita and affected property owners, must be employed by the NCWD in any change or modification of Urban Water Management Plan 2000; and SECTION 4. Any changes or modifications of Urban Water Management Plan 2000, including those outlined under proposed NCWD Resolution 2004-3, must contain specific adherence to and be consistent with the California Environmental Quality Act; and SECTION 5. The NCWD, in further consideration of and prior to adoption of proposed NCWD Resolution 2004-3, is requested to provide to the City of Santa Clarita a written analysis of the specific impacts on project applications currently pending before the City of Santa Clarita and those which have been approved and may be impacted by adoption of Resolution 2004-3; and SECTION 6. A certified copy of this resolution shall be transmitted to the Board of Directors of the NCWD. SECTION 7. The City Clerk shall certify to the adoption of this Resolution.
