HomeMy WebLinkAbout2004-04-27 - RESOLUTIONS - VACATE PORTION BAYWOOD LANE (2)RESOLUTION NO. 04-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, DECLARING ITS INTENTION TO VACATE A PORTION OF BAYWOOD LANE BETWEEN BROOKINGS COURT AND NEWHALL RANCH ROAD IN THE CITY OF SANTA CLARITA WHEREAS, a portion of Baywood Lane between Brookings Court and Newhall Ranch Road is no longer needed; and WHEREAS, sewer, gas, water, telephone, electric, and storm drain facilities will retain easements over the portion to be vacated; and WHEREAS, the proposed street vacation is determined to be a project and was reviewdd pursuant to the provisions of the California Environmental Quality Act. THEREFORE, pursuant to the provisions of the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California, the City Council of the City of Santa Clarita, California, does resolve, declare, determine, and order as ._ follows: SECTION 1. That it is the intention of the City Council of the City of Santa Clarita, California, to order the vacation of Baywood Lane between Brookings Court and Newhall Ranch Road as shown on Exhibit "A," located within the City of Santa Clarita, proposed to be vacated under Section 8320 of Chapter 3 of the Streets and Highways Code. SECTION 2. That the hour of 6:00 p.m., or as soon thereafter as possible, on Tuesday, May 25, 2004, at City Hall, 23920 Valencia Boulevard, within the City of Santa Clarita, is the time and place when and where any and all persons interested in or objecting to the proposed vacation of this public street may appear before the City Council to be heard, offer testimony, and submit evidence in relation thereto. SECTION 3. That the City Clerk of the City of Santa Clarita, California, is hereby directed to cause "NOTICE OF STREET VACATION OF BAYWOOD LANE BETWEEN BROOKINGS COURT AND NEWHALL RANCH ROAD WITHIN THE CITY OF SANTA CLARITA, CALIFORNIA, AND PUBLIC HEARING THEREON" to be published and posted as required by the "Street Vacation Act of 1941," being Part 3 of Division 9 of the Streets and Highways Code of the State of California; and the City Council of the City of Santa Clarita, California, hereby elects to proceed under the provisions of that Act. SECTION 4. The City Clerk shall certify to the passage of this Resolution and shall cause it to be published and posted in the manner prescribed by law.
