AMEND THE CONTRACT FOR THE OPERATION AND
MAINTENANCE OF TRANSIT SERVICE

RECOMMENDED ACTION
City Council authorize City Manager to negotiate and execute a two-year contract extension with
ATC for the operation and maintenance of the City's transit service, subject to City Attorney
approval.
BACKGROUND
The City Council first awarded contract for the operation and maintenance of transit service to
ATC in 1996. On June 26, 2001, ATC successfully competed for award of a second five-year
contract. For nearly nine years, ATC has satisfactorily performed its contractual responsibilities.
In addition, ATC has partnered closely with City staff throughout the design and construction of
the new Transit Maintenance Facility (TMF), including the compressed natural gas (CNG)
fueling facility.
The existing contract with ATC expires in August 2006. To competitively procure a new
contract beyond that date would require release of a Request for Proposals (RFP) early in 2006.
Although Transit operations are expected to be fully moved into the TMF this Fall, the actual
costs and savings created by the new facility are yet to be determined. Extending the existing
contract with ATC would retain the organizational integrity developed throughout the facility
design/build process, and would also provide two years to document the actual costs and
efficiencies of the TMF, prior to competitively procuring another contract.

FISCAL RVIPACT
The terms of the contract extension would become effective August 5, 2006. Contract rates
would be correlated with the U.S. Department of Labor Consumer Price Index (CPI) and the
Transit Fund forecast.
