SUBJECT: AWARD CONTRACT FOR EMERGENCY EXCAVATION OF
NEWHALL CREEK
DEPARTMENT: Building and Engineering
RECOMMENDED ACTION
City Council (four/fifths vote required):
1) Find there is sufficient evidence that the state of emergency will not permit delay resulting
from a competitive solicitation for bids;
2) Award the contract to Jimmie D. Foster Grading for the excavation of Newhall Creek under a
time and material contract with an initial estimated amount of $180,000.00 and a 15 percent
contingency of $27,000.00, for a total contract of $207,000.00, and authorize the City Manager
or designee to execute all documents, subject to City Attorney approval; and
3) Authorize the City Manager or designee to execute an agreement with the United States
Department of Agriculture Natural Resources Conservation Service (NRCS), subject to City
Attorney approval.
BACKGROUND
The intense storms which commenced on January 7, 2005, caused severe flooding and erosion
and resulted in the City Council declaring a local state of emergency.
Severe flooding occurred at the Polynesian Mobile Home Park at 23450 San Fernando Road.
This resulted in property damage and a danger to public safety. The City obtained the services of
Jimmie D. Foster Grading for the purpose of excavating Newhall Creek from the Polynesian
Mobile Home Park to a point north of the Valle Del Oro bridge to prevent further flooding.
City staff is investigating the possibility of reimbursement through several agencies, including
the NRCS.

Other action as determined by the City Council.
FISCAL IMPACT
Funds for this work have been taken from the Storm Drain Transfer budget, Account
No. M0032456.
