RECOMMENDED ACTION
City Council open the public hearing, receive staffs presentation, receive public testimony, close
the public hearing, discuss and introduce, and pass to second reading, an ordinance entitled "AN
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA,
CALIFORNIA, REPEALING CHAPTER 13.24 OF TITLE 13, DIVISION I OF THE SANTA
CLARITA MUNICIPAL CODE CONCERNING THE REGULATION OF NEWS VENDING
MACHINES IN THE PUBLIC RIGHT-OF-WAY AND ENACTING A NEW CHAPTER 13.24
OF TITLE 13, DIVISION I OF THE SANTA CLARITA MUNICIPAL CODE CONCERNING
THE REGULATION OF NEWSRACKS IN THE PUBLIC RIGHT-OF-WAY," on
February 22, 2005.
BACKGROUND
In 1997, the City adopted Ordinance No. 97-5. This ordinance was codified as Chapter 13.24 of
the Santa Clarita Municipal Code ("News Vending Code"). Since the adoption of Ordinance
No. 97-5, certain changes in applicable laws have occurred, and staff has gained experience in
the day-to-day administration of the News Vending Machine code. As a result, staff feels that
several non -substantive revisions of the administration of the regulations need to be made.
Staff, in conjunction with the City Attorney's office, has been in contact with the major
newspaper publications that currently have permits with the City, informing them of the proposed
new ordinance. A copy of the proposed ordinance was sent to the Daily News, The Signal, and
ordinance passed to
Second reading
Los Angeles Times. On December 9, 2004, staff and the City Attorney's office met with
representatives of the Daily News, The Signal, The Valley Press, and Los Angeles Times.
Comments by the newspapers were considered and changes were made to the proposed ordinance
based on that meeting. Staff has informed the newspaper representatives of the public hearing.
ALTERNATIVE ACTIONS
1. Other direction, amendments, or modifications as determined by the City Council.
2. City Council may choose not to introduce the proposed ordinance.
FISCAL IMPACT
No fiscal impacts are anticipated from this action, although there may be some savings to the
City as a result of changing the permit from a one- to two-year permit, therefore requiring less
staff time.
