HomeMy WebLinkAbout2005-04-26 - AGENDA REPORTS - ORD ADOPT LACO FIRE CODE (2)Agenda Item 4 CITY OF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: Item to be presented by: Ruben Barrera DATE: April 26, 2005 SUBJECT: FIRST READING OF AN ORDINANCE TO ADOPT THE LOS ANGELES COUNTY FIRE CODE DEPARTMENT: Building and Engineering RECOMMENDED ACTION City Council introduce the following ordinance as presented and set the ordinance for a second reading and public hearing on May 24, 2005, adopting by reference the Los Angeles County Fire Code Title 32 which includes the California Fire Code and Uniform Fire Code with certain amendments and is entitled, "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADOPTING BY REFERENCE TITLE 32 OF THE LOS ANGELES FIRE CODE WHICH CONSTITUTES THE 2001 EDITION OF THE CALIFORNIA FIRE CODE PUBLISHED BY THE CALIFORNIA BUILDING STANDARDS COMMISSION, INCLUDING APPENDIX I -C, APPENDIX II -C, APPENDIX II -D, AND APPENDIX VI -A, EXCLUDING ALL OTHER APPENDICES OF THE 2001 EDITION OF THE CALIFORNIA FIRE CODE, AND THE 2000 EDITION OF THE UNIFORM FIRE CODE, PREPARED AND PUBLISHED BY THE WESTERN FIRE CHIEFS ASSOCIATION, AND AMENDING CHAPTER 22.01 OF TITLE 22 OF THE SANTA CLARITA MUNICIPAL CODE." BACKGROUND The City is a member of the Los Angeles County Protection District and contracts with Los Angeles County for fire protection services. The City adopted the Los Angeles County Fire Code after incorporation as Title 22 in the Municipal Code to provide for the safety and welfare of its citizens and to establish and maintain consistency with the County. Subsequently, the City has adopted more recent editions of the Fire Code to ensure continued consistency with the County. The most current edition of the Los Angeles County Fire Code, however, has not been adopted by the City of Santa Clarita. Ordinance passed to Second reading This ordinance will amend the City's Municipal Code Title 22 to adopt by reference the most current edition of the County Fire Code and those codes referenced therein. Taking this action will ensure consistency between the City and County in the implementation and enforcement of the Fire Code while continuing to protect the safety and welfare of the citizens. Government Code Sections 50022.1 et seq. provides that when adopting another public entity's code by reference, the title of the ordinance is read at the first meeting and a public hearing is scheduled upon the second reading of the ordinance. The City is also required to have a copy of the proposed codes to be adopted by reference in the City Clerk's office for public inspection no less than 15 days prior to the public hearing. Therefore, included in the recommendation is for City Council to set the public hearing for May 24, 2005. If the City Council determines to schedule this ordinance for public hearing on the second reading, notice will be made in accordance with Government Code Section 50022.3. ALTERNATIVE ACTIONS 1. Submit and introduce an amended version of the proposed ordinance. 2. Take no action. FISCAL H PACT There is no fiscal impact by this action. The provisions of this code are already being enforced and no changes to the City budget are necessary. ATTACHMENTS Ordinance
