CITY OF SANTA CLARITA AGENDA REPORT Darren Hernandez City Manager Approval: Item to be presented by: December 13, 2005 RESULTS OF OPEN SPACE AND PARKLAND PRESERVATION DISTRICT Administrative Services RECOMMENDED ACTION City Council declare a "majority protest" exists following the ballot process to form the City of Santa Clarita Open Space and Parkland Preservation District, therefore requiring no further action. BACKGROUND On September 13, 2005, the Council approved the resolution of intention to form the proposed Open Space and Parkland Preservation District. The creation of a preservation district will provide the necessary funds to begin the process to acquire open space and parkland when opportunities for such acquisitions are made available, as well as provide the necessary funds for their stewardship. The resolution of intention authorized staff to mail Preservation District formation ballots to all City of Santa Clarita property owners. On October 5, 2005, 48,470 ballots were mailed. Pursuant to the 1972 Act and Proposition 218, property owners had until the end of the November 22, 2005 public hearing to return their ballots to the City Clerk. Ballots were mailed in October, which provided property owners at least 45 days' notice of this public hearing and instructed them to return their assessment ballots to the City Clerk by this date. Several public meetings have been held, as well as newsletters sent out to inform the property owners about the Open Space and Parkland Preservation District. On November 22, 2005, the City Council held the public hearing. On November 23, 2005, staff began counting the weighted ballots and now have the results of that count. A total of 17,257 ballots were counted. 9,154 ballots representing $329,554 of the assessment protested the formation of a Preservation District. This constitutes 60% of the returned weighted ballots. 8,103 ballots representing $221,213 of the assessments were in favor of the formation of the Preservation District. This constitutes 40% of the returned weighted ballots. Therefore, upon tonight's acceptance of the results, a majority protest does exist, and the City Council will not proceed with the formation of the Preservation District. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT There is no fiscal impact from the adoption of the recommended action.
