SUBJECT: PARCEL MAP NO. 60894 (NORTHEASTERLY CORNER OF
SIERRA HIGHWAY AND VIA PRINCESSA) - APPROVAL OF
FINAL MAP AND ACCEPTANCE OF OFFERS OF DEDICATION

RECOMMENDED ACTION
1. City Council approve Parcel Map No. 60894 (northeasterly comer of Sierra Highway and
Via Princessa);
2. Accept on behalf of the public the vacation of the slope easement as called out on this map
and the offers of dedication for public use and road purposes, Via Princessa, as shown on this
map; the right to restrict direct vehicular ingress and egress to Via Princessa; the easements
for sanitary sewers and sanitary sewer ingress and egress purposes; and all sanitary sewers
and appurtenant structures;
3. Make findings as follows: (a) that this project is consistent with the provisions of Sections
66474, and 66474.1 of the Subdivision Map Act and should be approved, and (b) that this
proposed subdivision, together with the provisions for this design and improvement, is
consistent with the General Plan required by Article 5 (commencing with Section 65300) of
Chapter 3 of Division 1 of the Government Code, or any specific plan adopted pursuant to
Article 8 (commencing with Section 65450) of Chapter 3 of Division 1 of the Government
Code;
4. Instruct the City Treasurer to endorse the Special Assessment Certificate on the face of Parcel
Map No. 60894, which indicates that all special assessments levied by the City have been
paid;
5. Instruct the City Clerk to endorse the Certificate on the face of Parcel Map No. 60894, which
embodies the approval of said maps and the acceptance of the dedications shown thereon;
and
6. Instruct the City Engineer t9 endorse the Certificate on the face of Parcel Map No. 60894,
which provides for verification of substantial conformance with the Tentative Map and all
provisions of local ordinances and state laws applicable at the time of approval.

BACKGROUND
Parcel Map No. 60894 was deemed to be in substantial conformance with the principles and
standards required by the Unified Development Code and approved by the Planning Commission
on September 21, 2004. Parcel Map No. 60894 consists of 3.951 acres located at the
northeasterly comer of Siena Highway and Via Princessa. The property is owned by Ronald E.
Carr and Lois H. Carr, Trustees of the Carr Family Trust dated June 16, 1989, David H. Paynter,
F. Patterson Willsey, and Via Princessa Partners, L.P., a California Limited Partnership.
Parcel Map No. 60894 is a subdivision of the remainder parcel of Tract Map No. 50484, and is
creating three lots for commercial use. Water rights have been secured for the lots. The site is
for commercial purposes only and has no Quimby and Transit Impact -Fee requirements. Bridge
and Thoroughfare (B&T) fees totaling $107,520.00 (per 1996 Eastside B&T District fees) have
been fully satisfied, as stipulated in the Conditions of Approval.
The conditions set by the Planning Division staff have been met and the map has been checked to
the satisfaction of the City Engineer and are ready for City Council approval and acceptance of
the dedications.
ALTERNATIVE ACTIONS
Staff has not identified any alternative actions that would conform to requirements set forth in the
Subdivision Map Act.
FISCAL IMPACT
No new public streets are being dedicated to the City by these maps. No impact will be made to
the City's Street Maintenance Budget.
The developer is contributing the following amounts for the purposes described below:
Bridge and Thoroughfare Fee: $107,520.00
