C2001 - AWARD CONSTRUCTION CONTRACT Building and Engineering RECOMMENDED ACTION 1. City Council approve the plans and specifications, and award the construction contract for the San Fernando Road Median Improvement, Project No. C2001, to Security Paving Company in the amount of $387,705.00 and other associated project costs for a total project cost of $439,069.00; 2. Continue to Fiscal Year 2005-06 the total remaining unused San Fernando Road Median appropriations of $360,069.00, and appropriate accordingly $310,344.00 to C2001001-8001 from Fund 001 General Fund Balance, and $49,725.00 to C2001201-8001 from Fund 201 Gas Tax fund balance; 3. Appropriate additional funds in the amount of $79,000.00 from Fund 303 Via Princessa Bridge and Thoroughfare to C2001303-8001; and 4. Authorize the City Manager or designee to execute all documents, subject to City Attorney approval. In October 1997, Development Review No. 97-152 was approved to expand an existing self -storage property located at 25333 San Fernando Road. As a condition of the project, the applicant was required to pay the City a fee for future construction of a median along the property's frontage in lieu of the applicant installing the median. The self -storage facility has since been completed, and the City is ready to construct the median. The plans and specifications have been reviewed and approved by the Los Angeles County Fire Department. The property has been annexed into the Landscape Maintenance District to provide for the ongoing maintenance for the median. The San Fernando Road Median Improvement project was duly advertised, and bids were scheduled to be received by the City's Purchasing Office on June 2, 2005. By the deadline for the receipt of bids, no bids had been received, although seven prime contractors and sub -contractors paid for plans and specifications in advance of the bid opening date. Subsequent phone calls to those contractors revealed that the contractors elected not to bid on this project because of other work they were bidding on, or an inability to complete this project along with their current work loads. After having bid the project, but not receiving bids, staff consulted with both the Purchasing Division and the City Attorney's Office. Since staff followed appropriate procurement procedures, despite the lack of bids received, the City is not subject to conducting a second bid process for this project, pursuant to Public Contract Code Section 20166. Therefore, the City can proceed to award the contract through the negotiation process. Staff negotiated with Security Paving Company, Inc. using recent City bid prices for various projects. As a result of these negotiations, the City may enter into a contract with Security Paving Company, Inc. in the amount of $387,705.00 to complete the San Fernando Road Median Improvement project. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT Of the $363,000.00 originally budgeted for the C2001 project in Fiscal Year 2004-05, $360,069.00 remained available at the close of Fiscal Year 2004-05. Due to the lack of receipt of bids on the C2001 project during Fiscal Year 2004-05, the respective General Fund 001 and Gas Tax Fund 201 budgeted funds of $310,344.00, and $49,725.00 were unspent, allowing for additional available fund balance of the same amount to remain available for Fiscal Year 2005-06. Appropriation of $79,000.00 from Fund 303 Via Princessa Bridge and Thoroughfare District fund balance will adequately fund the remainder of the contract and will leave a remaining available fund balance of $2,156,088.00 and remaining available cash of $392,621.00 in Fund 303. The total Fiscal Year 2005-06 available budget for this project will amount to $439,069.00. ATTACHMENTS Exhibit "A" - Location Map
