AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF SANTA CLARTTA
APPROVING ZONE CHANGE 04-001 (MASTER CASE 04-287)
TO CHANGE THE SOUTHERN 18.6 ACRES OF THE 33 -ACRE PROJECT SITE FROM
COMMERCIAL NEIGHBORHOOD (CN) TO RESIDENTIAL MEDIUM HIGH (RMH)
LOCATED AT THE NORTHEAST AND NORTHWEST CORNER OF ROBERT C. LEE
PARKWAY AND GOLDEN VALLEY ROAD IN THE CITY OF SANTA CLARITA
THE CITY COUNCIL OF THE CITY OF SANTA CLARiTA, CALIFORNIA DOES ORDAIN
AS FOLLOWS:
SECTION 1: FINDINGS OF FACT: The City Council does hereby make the following findings
of fact:
a. On July 6, 2004, an entitlement application was filed by Centex Homes (the "applicant)
with the Department of Planning and Economic Development which included the
following requests: an amendment to the General Plan Land Use Element Land Use Map
to redesignate approximately 18.6 acres of Commercial Neighborhood (CN) land use to
RMH (Residential Medium High) land use; a zone change modifying the Unified
Development Code zoning designation of approximately 18.6 acres of property from CN
(Commercial Neighborhood) with a Planned Development Overlay to RMH (Residential
Medium High) with a Planned Development Overlay; a Tentative Tract Map to subdivide
the project site to allow for three lots with 167 detached condominium units; a Hillside
Review to grade on a project site with over 10% average cross -slope and; a Conditional
Use Permit because the project site has a PD (Planned Development) Overlay; and
b. An Initial Study and Mitigated Negative Declaration was prepared, circulated and
approved in compliance with the California Environmental Quality Act (CEQA); and
C. The Planning Commission held a duly noticed public hearing on this issue commencing
on April 5, 2005 at 7:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarita. At
the hearing described above, the Planning Commission considered staff presentations,
staff reports, applicant presentations, public testimony on the proposal, and the Mitigated
Negative Declaration prepared for the project. The Planning Commission recommended
approval of the Mitigated Negative Declaration prepared for the project, and the general
plan amendment, zone change (approved by separate ordinance), tentative tract map,
hillside review, and conditional use permit; and
CL At the April 5, 2005, hearing before the Planning Commission, in the recommendation of
approval for the project, the Planning Commission encouraged the applicant to gate the
entries to the three lots. The applicant revised the application and included gates to
the entries. With this revision, the number of proposed units was reduced from 167 to
166. The applicant resubmitted the revised application with 166 proposed units and gated
entries on May 27, 2005.
e. The City Council held a duly noticed public hearing public hearing on this issue
commencing on June 28, 2005, at 6:00 p.m. at City Hall, 23920 Valencia Boulevard,
Santa Clarita.
SECTION 2. Based upon the testimony and other evidence received at the hearing, and upon the
study and investigation made by the Planning Commission and on its behalf, the City Council
further finds as follows:
a. That the proposed zone change is consistent with the objectives of the Unified
Development Code, the General Plan, and development policies of the City and approve
the Zoning Map (Exhibit 'W) from Commercial Neighborhood Planned Development
(CN PD) to Residential Medium High Planned Development (RMH PD).
The project site is located on a street, Robert C. Lee Parkway, shared with an existing
high school. Other land adjacent to the site is currently vacant, though designated RMH.
The requested land use designated change from commercial to residential would allow
the development of residential uses consistent with the surrounding land use designation
of RMH, and complimentary to the existing adjacent use, Golden Valley High School,
located to the north of the area requested under the zone change application.
As proposed, the project is consistent with the residential development standards outlined
in Section 17.15 of the City of Santa Clarita Unified Development Code (UDC) such as
building separation, setback, density, the inclusion of landscape parkways in the design of
the development, providing on-site recreational amenities, and height of the structures. In
addition, the project is consistent with the development standards outlined in the City's
Architectural Design Guidelines for the development of residential property such as the
location of the buildings on the site, on-site circulation, design of the structures and the
inclusion of articulation on all sides of the buildings.
SECTION 3. The City Council approves Master Case 04-287, Zone Change 04-001, the request
to re -designate the southern 18.6 acres of the project site from Commercial Neighborhood with a
Planned Development Overlay (CN PD) to Residential Medium High with a Planned
Development Overlay (RMH PD).
SECTION 4. The City Clerk shall certify to the passage of this Ordinance and shall cause the
same to be published as required by law.
PASSED, APPROVED, AND ADOPTED this 12th day of July, 2005.
