HomeMy WebLinkAbout2005-07-12 - ORDINANCES - MC04-486 AMERICAN BEAUTY ZONE (2)ORDINANCE NO. 05-11 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARTTA APPROVING ZONE CHANGE 04-005 (MASTER CASE 04-486) TO CHANGE THE EASTERN 4.3 ACRES OF THE 9.3 -ACRE PROJECT SITE FROM COMMUNITY COMMERCIAL (CC) TO RESIDENTIAL MODERATE (RM) LOCATED AT THE INTERSECTION OF SIERRA HIGHWAY AND AMERICAN BEAUTY WAY IN THE CITY OF SANTA CLARITA THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1: FINDINGS OF FACT. The City Council does hereby make the following findings of fact: a. On December 3, 2004, an entitlement application was filed by W & K Homes (the "applicant') with the Department of Planning and Economic Development which included the following requests: an amendment to the General Plan Land Use Element Land Use Map to redesignate approximately 4.3 acres of Community Commercial (CC) land use to RM (Residential Moderate) land use; a zone change modifying the Unified Development Code zoning designation of approximately 4.3 acres of property from CC (Community Commercial), a Tentative Tract Map to subdivide the project site to allow for 55 condominium units; an Oak Tree Permit to relocate an existing oak tree on the project site; a Hillside Review to grade on a project site with over 10% average cross -slope and to import 65,000 cubic yards of earth to the site; and b. An Initial Study and Mitigated Negative Declaration was prepared, circulated and approved in compliance with the California Environmental Quality Act (CEQA); and C. The Planning Commission held a duly noticed public hearing on this issue commencing on May 17, 2005, at 7:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarity At the hearing described above, the Planning Commission considered the staff presentation, staff report, applicant presentation, public testimony on the proposal, and the Mitigated Negative Declaration prepared for the project. The Planning Commission adopted Resolution P05-18 recommending the City Council adopt the Mitigated Negative Declaration prepared for the project, and approve the General Plan Amendment, zone change, tentative tract map, hillside review, and oak tree report; and d. The City Council held a duly noticed public hearing public hearing on this issue commencing on June 28, 2005, at 6:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarity At the hearing, the City Council approved the project with a 5-0 vote and passed to a second reading on July 12, 2005. SECTION 2. Based upon the testimony and other evidence received at the hearing, and upon the study and investigation. made by the City Council and on its behalf, the City Council further finds as follows: a. That the proposed zone change or amendment is consistent with the objectives of the Unified Development Code, the General Plan, and development policies of the City. The existing surrounding uses are single family and multi family residential and daycare/school. These uses are compatible with the proposed residential development. Commercial uses generate more vehicular trips per day than residential uses resulting in more traffic at the intersection of American Beauty Way and Sierra Highway. The project proposed, 55 condominium units, generates 322 trips per day. On 5.0 acres, zoned CC, the UDC would allow approximately 40,000 square feet of building area. Retail and office uses would generate 3,800 trips per day. The increased trip generation could warrant improvements to Sierra Highway such as additional tum lanes at the intersection of American Beauty Way. This residential project does not require changes to the adjacent rights-of-way, with the exception of the right-of-way dedication and the improvements to the project site frontage such as sidewalks and street trees. Compliance with the intent of the CC zone would include development of a community shopping center with at least two major users, which would require significant grading on the project site to allow for building pads and on site parking. This grading would also impact the base of the Primary Ridgeline located on the western portion of the site. Construction of the proposed multi -family units will require removal and recompaction of the earth in the development area of the project site and the import if 65,000 cubic yards of earth to the project site to increase the elevation of the building pads above the flood plain. With the proposed residential development, no development will occur on the base of the designated Ridgeline. The proposed residential development will comply with the RM zone development standards consistent with the summary of the RM zone. The project is 9.3 acres in size. The zoning designation of the 4.3 eastern portion of the site is CC, and the remaining 5.0 acres is zoned RM. The applicant proposes to change the zoning designation of the project site to RM from CC. As proposed, the project is consistent with the residential development standards outlined in Section 17.15 of the City of Santa Clarita Unified Development Code (UDC) such as building separation, setback, density, the inclusion of landscape parkways in the design of the development, providing on-site recreational amenities, and height of the structures. In addition, the project is consistent with the development standards outlined in the City's Architectural Design Guidelines for the development of residential property such as location of the buildings on the site, on-site circulation, design of the structures and the inclusion of articulation 2 on all sides of the buildings. SECTION 3. The City Council approves the request to re -designate the eastern 4.3 acres of the project site from Community Commercial (CC) to Residential Moderate (RM), as shown on Exhibit A attached. r SECTION 4. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
