HomeMy WebLinkAbout2005-01-25 - ORDINANCES - UPPER STONECREST PREZONE (2)ORDINANCE NO. 05-2 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, TO APPROVE PREZONE NO. 04-002 (MASTER CASE 04-411) FOR THE UPPER STONECREST ANNEXATION AREA GENERALLY LOCATED IN CANYON COUNTRY ABUTTING THE EASTERN CITY BOUNDARY NORTH OF SOLEDAD CANYON ROAD THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA DOES ORDAIN AS FOLLOWS: SECTION 1: FINDINGS OF FACT. The City Council does hereby make the following findings of fact: a. At a community meeting held September 15, 2004, and at a homeowner's association meeting held October 20, 2004, residents indicated overwhelming support for annexation. This support was further affirmed at on October 30, 2004, when City staff and Mayor Pro Tem Smyth visited the residences of Upper Stonecrest. b. Such prezoning would become effective upon annexation and designated upon the Zoning Map incorporated within and part of Title 17 of the City's Unified Development Code. c. The Planning Commission held a duly noticed public hearing on this issue on December 7, 2004. This public hearing was held at 7:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarita. At the hearing, the Planning Commission considered staff's presentation, staff report, and public testimony on the proposal, and the Negative Declaration prepared for the project. Notice of said public hearings was given in the manner required by the Santa Clarita Municipal Code and State law. SECTION 2. Based upon the testimony and other evidence received at the hearing, and upon the study and investigation made by the Planning Commission and on its behalf, the City Council further finds as follows: a. The purpose of the proposal is to prezone the project site to RS (Residential Suburban) upon adoption of proposed General Plan Amendment No. 04-005, and the Negative Declaration prepared for the project, approved under separate resolution. b. That the prezone has been reviewed for consistency with the City s proposed General Plan Amendment No.04-005. c. Public participation and notification requirements pursuant to Sections 65090 and 65391 of the Government Code of the State of California were duly followed. Ordinance No. 05-2 Page 2 d. The Negative Declaration prepared for this project was approved by separate resolution by the City Council on January 11, 2005. SECTION 3. FINDINGS FOR PREZONE. Based upon the foregoing facts and findings, the City Council hereby finds as follows: a. That a need for the prezone of RS (Residential Suburban) does exist within the area of the project site so the site can be annexed in to the City of Santa Clarita and so the site's zoning designations would be consistent with the existing development in the annexation area and the adjacent residential neighborhoods. b. That the subject property is a proper location for the proposed zoning designation because the site has been developed in compliance with the development standards for the proposed zone and is adjacent to areas with the similar and compatible zoning designations and similar type of development. c. That public necessity, convenience, general welfare and good planning practice justifies the prezone classification proposed because the development will be consistent with the surrounding development and consistent with the City's development standards. d. That the proposed prezoning designation is consistent with existing land uses in the area and would not result in a substantive change to the existing zoning of the project site, as the area and the adjacent developed area is developed in compliance with the proposed zone's development standards. e. That the project site consists of approximately 261 acres of land, contiguous to the corporate limits of the City of Santa Clarita. The project area contains 178 single family residences, a private park, and common areas mainly devoted to slopes. SECTION 4. The City Council approves the request to prezone the Upper Stonecrest Annexation area to the City of Santa Clarita zone RS, as shown on Exhibit A attached. SECTION 5. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
