HomeMy WebLinkAbout2005-01-11 - RESOLUTIONS - ADOPT NEGDEC GP UDC AMEND (2)RESOLUTION NO. 05-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, ADOPTING A NEGATIVE DECLARATION FOR MASTER CASE 04-285, UNIFIED DEVELOPMENT CODE AMENDMENT 04-001 AND GENERAL PLAN AMENDMENT 04-004 CONSISTING OF AMENDMENTS TO THE UNIFIED DEVELOPMENT CODE AND A GENERAL PLAN AMENDMENT TO THE LAND USE ELEMENT OF THE CITY OF SANTA CLARITA GENERAL PLAN THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council does hereby find and determine as follows: a. On June 25, 1991, the City Council adopted Resolution No. 91-98, adopting the General Plan of the City of Santa Clarita and certifying the Environmental Impact Report; and b. On February 17, 2004, the Planning Commission held a study session to provide staff direction on sections of the Unified Development Code to review and modify; and C. On July 6, 2004, the City of Santa Clarita (the "Applicant") initiated an application to revise various sections of the Unified Development Code (Title 16 and 17 of the City of Santa Clarita Municipal Code) and to amend the Land Use Element of the General Plan of the City of Santa Clarita to include the Valley Center Concept overlay designation to the San Fernando Road corridor within the Downtown Newhall Special Standards District; and d. On July 20, 2004, the Planning Commission held a study session to discuss the proposed revisions to the Unified Development Code. At this study session, the Planning Commission provided staff with additional direction on the proposed changes; and e. On September 21, 2004, the Planning Commission held a study session to review the proposed changes to the City's Oak Tree Preservation Ordinance as requested at the joint City Council and Planning Commission Study Session held on May 4, 2004; and f. The project was reviewed in compliance with the California Environmental Quality Act (CEQA) and was found to have no impact to the environment and a Negative Declaration was prepared; and g. The project was duly noticed in accordance with the noticing requirements for a General Plan and Unified Development Code Amendment on September 28, 2004 and October 26, 2004; and h. The Planning Commission held a duly noticed public hearing on this issue commencing on October 19, 2004, at 7:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Resolution No. 05-7 Page 2 Clarita. At the hearing, the Planning Commission considered a staff presentation, staff report, public testimony on the Unified Development Code Amendments, General Plan Amendment and the Negative Declaration prepared for the project; and i. At the October 19, 2004, public hearing, the Planning Commission adopted Resolution PO4-30 which recommends approval of Master Case 04-285 which is comprised of General Plan Amendment 04-004 and Unified Development Code Amendment 04-001; and j The City Council held a duly noticed public hearing on this issue commencing on November 23, 2004, at 6:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarita; and k. The City Council heard public testimony, received a staff presentation and directed that the item be continued to the January 11, 2005 City Council meeting to allow for further review of the proposed changes; and 1. At the hearing described above, the City Council considered a staff presentation, staff report, public testimony on the Unified Development Code Amendments, and the Negative Declaration prepared for the project. SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS. Based upon the foregoing facts and findings in the Initial Study prepared for the project, the City Council further finds and determines as follows: a. An Initial Study and a Negative Declaration for this project have been prepared in compliance with the California Environmental Quality Act (CEQA). b. The Initial Study has been circulated for review and comment by affected governmental agencies and the public, and all comments received, if any, have been considered. The document was posted and advertised on October 22, 2004, in accordance with CEQA. The public review period was open from October 22, 2004, through November 23, 2004. C. There is no substantial evidence that the project will have a significant effect on the environment. The Negative Declaration reflects the independent judgment of the City of Santa Clarita. d. The location of the documents and other material which constitutes the record of proceedings upon which the decision of the City Council is the Master Case 04-285 project file within the Planning and Economic Development Department and is in the custody of the Director of Planning and Economic Development. SECTION 4. The City Clerk shall certify the adoption of this Resolution. Resolution No. 05-7 Page 3 PASSED, APPROVED AND ADOPTED this 11`s day of January, 2005.
