HomeMy WebLinkAbout2005-06-14 - RESOLUTIONS - LACO 16TH ST STORMDRN (2)RESOLUTION NO. 05-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, APPROVING THE CONSTRUCTION OF THE 16TH STREET STORM DRAIN REPLACEMENT PROJECT WHEREAS, the Los Angeles County Board of Supervisors authorized the design and construction of the 16th Street Storm Drain Replacement project; and WHEREAS, the existing drainage system is located on private property and is servicing public drainage. This project will replace the existing storm drain improvements with a system located in the public right-of-way; and WHEREAS, the County will take responsibility for the replacement of the existing storm drain improvements within the 16th Street and Walnut Street rights-of-way. The City will take responsibility for addressing issues outside the road right-of-way and abandon the existing storm drain system on private property; and of 2005. WHEREAS, the subject project is scheduled to begin construction in the summer NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. The City Council of the City of Santa Clarita hereby approves the project plans and specifications, concur with the County's environmental findings for the project; authorizes the Los Angeles County Flood Control District to proceed with the construction of the project; grant permission to the Los Angeles County Flood Control District to occupy and use the public streets in the City of Santa Clarita to construct, operate, and maintain said installation; and issue the needed encroachment permit on a no -fee basis. SECTION 2. The City of Santa Clarita, where legally possible and upon the request by the Los Angeles County Flood Control District, will grant, transfer, or assign all prior rights over utility companies when necessary to construct and complete this project. SECTION 3. Once the project has been installed, the City of Santa Clarita shall not hold the Los Angeles County Flood Control District responsible for the expense of relocation, alteration, and modification of this project necessitated by future street improvements, realignments, alterations, or reconstruction. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
