HomeMy WebLinkAbout2005-06-28 - RESOLUTIONS - OSMD ANNUAL LEVY ASMT GVRANCH (2)RESOLUTION NO. 05-73 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARTTA, CALIFORNIA, INITIATING PROCEEDINGS FOR THE ANNUAL LEVY OF ASSESSMENTS AND ORDERING THE PREPARATION OF AN ENGINEER'S REPORT FOR THE OPEN SPACE MAINTENANCE DISTRICT (GOLDEN VALLEY RANCH) WHEREAS, the City Council of the City of Santa Clarita (the "City") desires to undertake proceedings pursuant to the provisions of the "Landscaping and Lighting Act of 1972," being Part 2 of Division 15 of the California Streets and Highways Code (commencing with Section 22500) (the "Act") and in accordance with Article XIiID of the California Constitution and the Proposition 218 Omnibus Implementation Act (commencing with Section 53750 of the California Government Code) to form a maintenance assessment district (the "District"); and WHEREAS, the District is an existing assessment district in which assessments are not proposed to be increased as defined by Article XIIID of the California Constitutions (Proposition 218) and the Proposition 218 Omnibus Implementation Act, and is therefore exempt from the procedures and requirements pursuant to California Constitutions Article XII Section 5 (a): and WHEREAS, the City Council wishes to initiate proceeding to provide for the annual levy of assessments for the next ensuing fiscal year to provide for the annual costs for maintenance of improvements defined as open space, with in the District. NOW, THEREFORE, the City Council of the City of Santa Clarita, does hereby resolve as follows: SECTION 1 The above recitals are true and correct. SECTION 2. That the public interest and convenience requires, and it is the intention of the legislative body to levy and collect assessments to pay the annual costs and expenses for the maintenance and/or servicing of the improvement for the District, with the improvements general described as follows: (a) Improvements include but are not limited to trail maintenance and open space management within the boundaries of said District. SECTION 3. Harris & Associates, an engineer registered pursuant to the Professional Engineers Act (Chapter 7, commencing with Section 670, of Division 3 of the Business and Professions Code), has been designated Assessment Engineer for the proposed District. Harris & Associates is hereby ordered to prepare and file an "Engineer's Report" for the City Council's review, consideration, and adoption in accordance with the Act and the laws of the State of California. SECTION 4. That the Report shall include all costs and expenses of said open space 7 maintenance and/or servicing relating to the fiscal year commencing July 1, 2005 and ending June 30, 2006. 4 - SECTION 5. The City Clerk shall certify to the passage and adoption of this resolution, shall cause the same to be entered in the book of resolutions of the City, and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of the City in the minutes of the meeting at which the same is presented.
