HomeMy WebLinkAbout2005-07-12 - RESOLUTIONS - RECYCLING MARKET NEGDEC ZONE (2)RESOLUTION NO. 05-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA CLARITA, CALIFORNIA, SUPPORTING RENEWAL OF THE SANTA CLARITA RECYCLING MARKET DEVELOPMENT ZONE WHEREAS, the California Public Resources Code Section 42010 provides for the establishment of the Recycling Market Development Zone (RMDZ) program throughout the State of provide incentives to stimulate development of post -consumer and secondary materials forrecyclables; WHEREAS, the Santa Clarita RMDZ includes the City of Santa Clarita; WHEREAS, cities and counties must meet a 50 percent reduction in landfill waste disposal as mandated in the California Integrated Waste Management Act; WHEREAS, the Santa Clarita RMDZ designation will expire in October 2005 unless re -designated by the California Integrated Waste Management Board; WHEREAS, the City of Santa Clarita still desires existing and new recycling based manufacturing businesses locating within the region to be eligible for the technical and financial incentives associated with the RMDZ program; WHEREAS, the renewal of the Santa Clarita RMDZ is still necessary to facilitate local and regional planning, coordination, support of existing recycling based manufacturing, as well as attract private sector recycling business investments to the region; WHEREAS, the current and proposed waste management practices and conditions are favorable to the development of post consumer and secondary waste materials markets; WHEREAS, the California Legislature has defined environmental justice as "the fair treatment of people of all races, cultures, and incomes with respect to the development, adoption, implementation, and enforcement of environmental laws, regulations, and policies" (Government Codes section 65040.12(e)], and has directed the California Environmental Protection Agency to conduct its programs, policies, and activities that substantially affect human health or the environment in a manner that ensures the fair treatment of people of all races, cultures, and income levels, including minority populations, and low income populations of the state (Public Resources Code section 71110(a)]; WHEREAS, the California Integrated Waste Management Board, in its Strategic Plan, has adopted a goal to continuously integrate environmental justice concerns into all of the Board's programs and activities; WHEREAS, the City Council, has considered the proposed Negative Declaration and, based 'upon the findings set forth below, hereby finds that Negative Declaration for this project has been prepared in compliance with CEQA: A. An Initial Study and a Negative Declaration for this project have been prepared in compliance with the California Environmental Quality Act (CEQA); 1-1P The Initial Study has been circulated for review and comment by affected governmental agencies and the public, and all co been considered. The Negative Declaration was 13, 2005, in accordance with CEQA. There is no substantial evidence that the project will have a significant effect on the environment. The Negative Declaration reflects the independent judgment of the City of Santa Clarita; D. The location of the documents and other material which constitutes the record of proceedings upon which the decision of the City Council within the Field Services Department and is in the custody of the Environmental Manager; and E. The City Council, based upon the findings set forth above, hereby finds that the Negative Declaration for this project has been prepared in compliance with CEQA. NOW, THEREFORE, the City Council of the City of Santa Clarita does hereby resolve as follows: SECTION 1. Adopts the Negative Declaration for the project to renew the Santa Clarita Recycling Market Development Zone. SECTION 2. Approves the submittal of a Recycling Market Development Zone renewal application to include the City of Santa Clarita. SECTION 3. Agrees to administer the RMDZ program in a manner that seeks to ensure the fair treatment of people of all races, cultures and incomes, including but not limited to soliciting public participation in all communities within the RMDZ. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. r PASSED, APPROVED AND ADOPTED this 12th day of July, 2005.
