A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA CLARITA, CALIFORNIA, ADOPTING A MITIGATED NEGATIVE
DECLARATION FOR MASTER CASE 05-064, UNIFIED DEVELOPMENT CODE
AMENDMENT 05-002 CONSISTING OF AMENDMENTS TO
THE UNIFIED DEVELOPMENT CODE
THE CITY COUNCIL OF THE CITY OF SANTA CLARITA DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The City Council does hereby find and determine as follows:
a. On June 25, 1991, the City Council adopted Resolution No. 91-98, adopting the General
Plan of the City of Santa Clarita and certifying the Environmental Impact Report.
b. On June 21, 2005, the Planning Commission held a study session to provide staff
direction on sections of the Unified Development Code to review and modify and to
review the proposed Mixed Use Overlay Zone, the Vehicle Services Overlay Zone and
the Ridgeline Preservation Overlay Zone; and
C. On March 7, 2005, the City of Santa Clarita (the "Applicant') initiated an application to
revise various sections of the Unified Development Code (Title 16 and 17 of the City of
Santa Clarita Municipal Code); and
d. On September 6, 2005, the City Council and Planning Commission held a joint study
session to discuss the proposed Mixed Use Overlay Zone, the Vehicle Services Overlay
Zone and the Ridgeline Preservation Overlay Zone; and
e. The project was reviewed in compliance with the California Environmental Quality Act
(CEQA) and was found to have a less than significant impact to the environment with the
mitigation measures attached and a Mitigated Negative Declaration was prepared; and
f. The project was duly noticed in accordance with the noticing requirements for a Unified
Development Code Amendment on November 2, 2005; and
g. The Planning Commission held a duly noticed public hearing on this issue commencing
on November 1, 2005, at 7:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa
Clarita. At the hearing, the Planning Commission considered a staff presentation, staff
report, public testimony on the Unified Development Code Amendments and the
Mitigated Negative Declaration prepared for the project; and
h. At the November 1, 2005, public hearing, the Planning Commission adopted Resolution
P05-54 which recommends that the City Council approve Master Case 05-064 which is
comprised of Unified Development Code Amendment 05-002; and

i. The City Council held a duly noticed public hearing on this issue commencing on
November 22, 2005, at 6:00 p.m. at City Hall, 23920 Valencia Boulevard, Santa Clarita;
and
j. At the hearing described above, the City Council considered a staff presentation, staff
report, public testimony on the Unified Development Code Amendments, and the
Negative Declaration prepared for the project.
SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDINGS.
Based upon the foregoing facts and findings in the Initial Study prepared for the project, the City
Council further finds and determines as follows:
a. An Initial Study and a Mitigated Negative Declaration for this project have been prepared
in compliance with the California Environmental Quality Act (CEQA).
b. The Initial Study has been circulated for review and comment by affected governmental
agencies and the public, and all comments received, if any, have been considered. The
document was posted and advertised on October 2, 2005, in accordance with CEQA. The
public review period was open from October 2, 2005, through November 22, 2005.
C. Although staff found that there may be significant impacts related to traffic, noise, air
quality and housing, mitigation measures are attached that will reduce these impacts to
less than significant and a Mitigated Negative Declaration has been prepared for the
project in accordance with the CEQA. The Mitigated Negative Declaration reflects the
independent judgment of the City of Santa Clarita.
d. The location of the documents and other material which constitutes the record of
proceedings upon which the decision of the City Council is the Master Case 05-064
project file within the Community Development Department and is in the custody of the
Director of Community Development.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution.
