S1001 — AWARD CONSTRUCTION CONTRACT AND CONSTRUCTION SUPPORT CONTRACTS DEPARTMENT: Public Works RECOMMENDED ACTION City Council approve the plans and specifications, and award the construction contract to C.A. Rasmussen, Inc. in the amount of $16,181,457.50, and authorize a 15 percent contingency in the amount of $2,430,000.00; and award various construction support contracts and mitigation measures totaling $4,505,000.00 for the following: Generate a workorder for construction independent quality assurance to the County of Los Angeles in the amount of $80,000.00; Award the quality assurance for materials testing, soils testing, and inspection service contract to R.T. Frankian Associates in the amount of $500,000.00; Award the construction surveying and staking service contract to Sikand Engineering in the amount of $500,000.00; Award the engineering design construction support service contract to Tetra Tech, Inc. in the amount of $300,000.00; Award the environmental consulting service contract to Aquatic Consulting Services in the amount of $200,000.00; Award the labor compliance consulting service contract to Padilla and Associates in the amount of $100,000.00; Authorize miscellaneous expenditures totaling $1,000,000.00 for overall support including construction management, a public works inspector, and the lease or purchase of two vehicles for use during construction. Authorize a change order to the City's contract with TruGreen in the amount of $300,000.00, allowing the Urban Forestry Division to clear trees and brush in advance of the construction work and prior to bird nesting season; Award the Oak Tree Relocation and Oak Tree Maintenance Agreement to Valley Crest Tree Company in advance of the construction work in the amount of $20,000.00; APPROVED • Authorize a 28 -acre Conservation Easement for offsite mitigation on the City -owned Wagoner Property and assign a fair -market value of $1,400,000.00 to pay the City from the Valencia Bridge and Thoroughfare District the assigned market value for mitigation land; Authorize funds and enter into an agreement with the Mountains Recreation and Conservation Authority (MRCA) for offsite mitigation and monitoring, estimated at $25,000.00, to satisfy offsite mitigation required by the United States Army Corps of Engineers (ACOE) and the California Department of Fish and Game (CDFG) that are impacted by the Cross Valley Connector Gap Closure project; • Authorize a mitigation project to purchase and install approximately 90 replacement trees removed by the construction of the Cross Valley Connector Gap Closure project at an estimated amount of $80,000.00 to satisfy the CDFG permit requirements; Increase Valencia Bridge & Thoroughfare Revenue Account No. 304-6191 by $14,531,962.61 and appropriate to Expenditure Account No. S1001304-8001; increase Revenue Account No. 109-6714 by $991,307.00 and appropriate to Expenditure Account No. 51001109-8001; increase Revenue Account No. 205-5131 by $3,192,013.00 and appropriate to Expenditure Account No. 51001205-8001; and authorize the City Manager or designee to execute all documents, subject to City Attorney approval. BACKGROUND The Cross Valley Connector (CVC) Gap Closure project will extend Newhall Ranch Road from Interstate 5 to Copper Hill Drive. It is the western most segment of the CVC, which will provide a direct connection between Interstate 5 and State Route 14. On June 13, 2006, the City's Purchasing Division received the following bids for the project: Comnanv C.A. Rasmussen, Inc. Security Paving Co., Inc. Griffith Company Granite Construction, Inc. Palp, Inc. DBA Excel Paving Bid Amount $16,181,457.50 $16,490,653.44 $17,302,531.50 $17,586,876.00 $17,994,486.40 Location Simi Valley, CA Sun Valley, CA Santa Fe Springs, CA Lancaster, CA Long Beach, CA Staff recommends that the project be awarded to C.A. Rasmussen, Inc., the lowest responsive bidder with an amount of $16,181,457.50. C.A. Rasmussen, Inc. possesses a State Contractor's license and is in good standing with the State Contractor's License Board. The bid was reviewed for accuracy and conformance to the contract documents and was found to be complete. References were checked and indicated that this contractor has performed work that met their customers' goals. A Final Environmental Impact Report (FEIR) was prepared for the project and a Notice of Determination was filed in May 2005, thereby meeting the requirements of the California Environmental Quality Act (CEQA). Also, an Environmental Assessment, pursuant to the National Environmental Policy Act (NEPA), was completed for the project and the Federal Highway Administration (FHWA) issued the Finding of No Signification Impact (FONSI) in May 2005. The City is required to provide for offsite mitigation for the environmental impacts caused by the construction of the Cross Valley Connector Gap Closure. The offsite mitigation is determined by the CDFG and ACOE to be 28 acres. The mitigation site is required to be encumbered by a Conservation Easement drawn by the ACOE and managed by an agency separate from the City. The MRCA has agreed to manage the offsite mitigation site in perpetuity for an amount of $25,000.00. The MRCA is a local government public entity established in 1985 pursuant to the Joint Powers Act. The MRCA is a local partnership between the Santa Monica Mountains Conservancy, the Conejo Recreation and Park District, and the Rancho Simi Recreation and Park District. Included in the amount listed above for the City staff are funds to provide for one (1) Public Works Inspector. This new position will provide inspection services for this project. ALTERNATIVE ACTIONS Other action as determined by the City Council. FISCAL IMPACT The requested appropriations, combined with previous expenditures and current available budget will provide for all anticipated costs. In addition, a Construction Funding Agreement for Street Improvements was entered into between Newhall Land and the City in November 2005, which obligates Newhall Land to pre -pay the Valencia Bridge and Thoroughfare District any and all funding short falls for this project.
