City Council to allow the citizens of the City of Santa Clarita, on the April 2008 municipal
election ballot, to decide whether they want a directly elected mayor and if so, whether it be for a
two-year or four-year term.
BACKGROUND
The City Council requested staff to provide information regarding changing from a non -elected
mayor to an elected mayor. Changing to an elected mayor would need to be decided by the voters
pursuant to Government Code sections 34900 through 34901.
The office is established under Government Code by City Council action to place a measure on
the ballot, the form of which is controlled by section 34901. The measure must ask if the voters
prefer the office to have a two-year or a four-year term, although a subsequent election can be
held to alter a term from two to four years or vice versa. If the measure passes, one of the
Council seats on the next ballot is designated the mayor's seat and the post is filled by subsequent
election (California Government Code 34902).
The ballot would read:
A. Shall the City of Santa Clarita have a directly elected mayor?

No
B. Shall the term of office be for 2 year of 4 years?

The elected mayor "is a member of the City Council and has all of the powers and duties of a

member of the City Council." An elected mayor has all the powers of an appointed mayor set
forth in Government Code sections 40601 through 40604.

34900. At any general municipal election, or at a special election
held for that purpose, the city council may submit to the electors
the question of whether electors shall thereafter elect a mayor and
four city councilmen, and whether the mayor shall serve a two-year or
four-year term. In cities presently having elected mayors, the city
council may also submit to the electors the question of whether the
mayor shall thereafter serve a two-year or a four-year term.
34901. The questions shall be printed on the ballots used at the
election in substantially the following form: "Shall the electors
elect a mayor and four city councilmen?" "Shall the term of office
of mayor be two years?" "Shall the term of office of mayor be four
years?" The words "Yes" and "No" and "two years" and "four years"
shall be so printed on the ballots that the voters may express their
choice. The term of office of mayor shall be that preferred by a
majority of those voting on the proposition.

40601. In the absence of the mayor, the mayor pro tempore shall
exercise the powers granted in this chapter.
40602. The mayor shall sign:
(a) All warrants drawn on the city treasurer.
(b) All written contracts and conveyances made or entered into by
the city.
(c) All instruments requiring the city seal.
The legislative body may provide by ordinance that the instruments
described in (a), (b) and (c) be signed by an officer other than the
mayor.
40603. He may administer oaths and affirmations, take affidavits,
and certify them under his hand.
40604. He may acknowledge the execution of all instruments executed
by the city and required to be acknowledged.
