SUBJECT: FEDERAL LEGISLATIVE ADVOCACY

RECOMMENDED ACTION
City Council authorize the City Manager or designee to execute, subject to City Attorney
approval, a contract for continuation of professional services with Jamison and Sullivan, Inc. for
the period of July 1, 2006 through December 31, 2006.
BACKGROUND
Since February 2001, the City has retained the professional services of Jamison and Sullivan, Inc.
for federal advocacy services specifically relating to the proposed Cemex mining proposal.
Jamison and Sullivan's current contract expires on June 30, 2006. The City Council is requested
to authorize continuation of professional services with Jamison and Sullivan, Inc. for the period
July 1, 2006 through December 31, 2006.
Jamison and Sullivan's current monthly retainer is $7,500, plus reimbursement for reasonable
out-of-pocket expenses, up to a maximum of $2,000. The total maximum amount for the
proposed contract extension will not exceed $47,000. Funding is already included in the
Proposed 2006/2007 City budget.
The Cemex opposition effort continues to contain a legislative component. On May 24, 2006,
Representative McKeon introduced HR 5471 regarding the Cemex mega -mining proposal. The
bill has been assigned to the House Resources Committee for consideration. Jamison and
Sullivan, Inc. will be responsible for working with members of Congress, appropriate
congressional committees, and administration officials to secure support for the measure.

Staff recommends that the contract with Jamison and Sullivan, Inc. be renewed for the period
July 1, 2006 through December 31, 2006. This new contract period will continue their scope of
services as exclusively working on the Cemex issue at a monthly retainer of $7,500, plus up to
$2,000 for reasonable out-of-pocket expenses; totaling a maximum of $47,000 during the
contract period.
ALTERNATIVE ACTIONS
1. Award contract for a period other than six months in duration.
2. Not award a contract to Jamison and Sullivan, Inc. and issue a request for proposals for
federal advocacy services related to the proposed Cemex mining project.
3. Other direction as determined by the City Council.
FISCAL IMPACT
Approval of the recommended action will result in a total maximum expenditure of $47,000,
which is already included in the proposed 2006/2007 budget.
