HomeMy WebLinkAbout2006-08-22 - AGENDA REPORTS - LMD 1 MAXIMUM RATE ANNEX 1G (3)Agenda Item: _ Z7 CITYOF SANTA CLARITA AGENDA REPORT CONSENT CALENDAR City Manager Approval: Item to be presented by: Dennis Luppens DATE: August 22, 2006 SUBJECT: RESOLUTION INITIATING PROCEEDINGS FOR THE MODIFICATION OF THE MAXIMUM ANNUAL LANDSCAPE MAINTENANCE DISTRICT ASSESSMENT RATE FOR LANDSCAPE MAINTENANCE DISTRICT NUMBER 1, ANNEXATION 1-G (TRACT 61811 - CENTEX DEVELOPMENT) ON GOLDEN VALLEY ROAD DEPARTMENT: Administrative Services RECOMMENDED ACTION City Council adopt a resolution to initiate proceedings to increase the maximum Landscape Maintenance District assessment rate from $56.45 per Equivalent Dwelling Unit (EDU) to $107.28 per EDU annually for Landscape Maintenance District Number 1, Annexation 1-G (Centex Development), approve the preliminary Engineer's Report, and set the Public Hearing for August 22, 2006. This action is recommended in order to correct an error made in the consulting Assessment Engineer's report for this property, which was previously presented to and approved by the City Council on July 11, 2006. BACKGROUND At the July 11, 2006 meeting, Council approved the annexation of various zones into Landscape Maintenance Districts Numbers 1 and T -l. These annexations included the Centex development of 166 single-family homes near Golden Valley Road. After the annexation, it was discovered that an incorrect rate was used in the Assessment Engineer's report. The purpose of staffs recommendation is to correct this error. Under the current rate, revenues would not offset the cost of landscape maintenance services from which the Centex project would benefit. The difference for FY 06-07 is estimated to be $8,600. It is recommended that the rate be increased from a maximum of $56.45 per Equivalent Dwelling Unit (EDU) annually to a maximum of $107.28 per EDU annually. This recommendation is made in accordance with the Landscape and Lighting Act of 1972 and Proposition 218 (Article 13D of the California Constitution). If the resolution is adopted, a public hearing will be held at tonight's meeting where public comments may be heard by the Council. The property owner, Centex Homes, has sent a ballot to the City Clerk, along with a petition -waiver, which allows for the expedition of the assessment ballot process. The property owner is aware of and supportive of the proposed new rate. ALTERNATIVE ACTIONS Other direction as determined by City Council. FISCAL IMPACT This action will increase the revenue from LMD assessments for this annexation by $8,600 for FY 06-07.
