MAXIMUM ANNUAL LANDSCAPE MAINTENANCE DISTRICT
ASSESSMENT RATE FOR LANDSCAPE MAINTENANCE
DISTRICT NUMBER 1, ANNEXATION 1-G (TRACT 61811 -
CENTEX DEVELOPMENT) ON GOLDEN VALLEY ROAD

RECOMMENDED ACTION
City Council conduct the public hearing, open and review the ballot, adopt a resolution, and
approve the Engineer's Report to increase the maximum Landscape Maintenance District
assessment rate from $56.45 per EDU to $107.28 per EDU annually for Landscape Maintenance
District Number 1, Annexation 1-G (Centex Development). This action is recommended in
order to correct an error made in the consulting Assessment Engineer's report for this property,
which was previously presented to and approved by the City Council on July 11, 2006.
BACKGROUND
At the July 11, 2006 meeting, Council approved the annexation of various zones into Landscape
Maintenance Districts Numbers 1 and T-1. One of these annexations included the Centex
development, which includes 166 single-family homes near Golden Valley Road. After the
annexation, it was discovered that an incorrect rate was used in the Engineer's report. The
purpose of staffs recommendation is to correct this error. Under the current rate, revenues would
not offset the cost of landscape maintenance services from which the Centex project would
benefit. The difference for FY 06-07 is estimated to be $8,600. It is recommended that the rate
be increased from a maximum amount of $56.45 per Equivalent Dwelling Unit (EDU) annually
to an amount of $107.28 per EDU annually.
The property owner has agreed to the new proposed rate. In fact, during the development

process, the proposed LMD rate estimate provided to the property owner was $108 per EDU
annually, but during the annexation balloting process, the property owner cast a ballot for a rate
of $56.45 per EDU annually. The property owner is aware that to change the rate, a new ballot is
required identifying the new rate. Staff is recommending this expeditious process rather than
waiting to make the corrections in conjunction with a future annexation, because there is only
one property owner. Future conditions will present multiple property owners, and pursuant to
Proposition 218, multiple ballots would need to be mailed.
This recommendation is made in accordance with the Landscape and Lighting Act of 1972 and
Proposition 218 (Article 13D of the California Constitution). The property owner, Centex
Homes, has sent a ballot to the City Clerk along with a petition -waiver, which allows for the
expedition of the assessment ballot process. After the close of the public hearing, the ballot will
be opened, and the result will be announced by the City Clerk.
ALTERNATIVE ACTIONS
Other direction as determined by City Council.
FISCAL IMPACT
This action will increase the revenue from LMD assessments for this annexation by $8,600 for
FY 06-07.

NOTICE IS HEREBY GIVEN:
A Public Hearing will be held before the City Council of the City of Santa Clarita in the City
Hall Council Chambers, 23920 Valencia Boulevard, 1st floor, Santa Clarita, California, on the
22"d day of August 2006, at or after 6:00 p.m., to consider the modification of the maximum
annual LMD levy for TR 61811 Centex Homes on Golden Valley Road.. This modification only
impacts the owner of TR 61811, Centex Homes. The LMD assessment is for landscape
maintenance as described in the Act identified below. The City Council, pursuant to the
Landscaping and Lighting Act of 1972, being a division of the Streets and Highways Code of the
State of California and the Benefit Assessment Act of 1982, being a division of the Government
Code, desires to levy annual assessments for the districts pursuant to Article 3M D of the
California Constitution.
Proponents, opponents, and any interested persons may appear and be heard on this matter at that

PETITION
A petition to the City Council of the City of Santa Clarita, County of Los Angeles, State of California, petitioning
said Council to initiate proceedings for the rate increase for Santa Clarita Landscape Maintenance District No. 1,
Zone 1, Annexation I -G (Centex Development), established pursuant to the Landscaping and Lighting Act of
1972 as set forth in Part 2 of Division 15 (Section 22500, et seq.) of the Streets and Highways Code of the State of
California.
A. WHEREAS, the petitioner, Centex Homes, is the sole owner of that certain real property located in
the City of Santa Clarita, County of Los Angeles, State of California, more particularly described as follows:

B. WHEREAS, the owner is developing the Property as a residential development in Santa Clarita,
(hereinafter referred to as the "Project"); and
C. WHEREAS, as a condition to its approval of the recordation of the final map to be recorded on
the Property, the City of Santa Clarita (hereinafter referred to as the "City") has required that those certain
landscape easement areas within the Project which are more particularly shown and described on Exhibit "A"
attached hereto (hereinafter referred to as the "Improvement Areas"), be improved with landscaping and other
related improvements (hereinafter referred to as the "Landscape Improvements") to a standard acceptable to the
City, and the Developer provide a means satisfactory to the City for assuring the continued maintenance, operation
and servicing of the Improvement Areas and pursuant to the "Landscaping and Lighting Act of 1972" as set forth
in Part 2 of Division 15 (Sections 22500, et seq.) of the Streets and Highways Code of the State of California, the
City may assess the property via an existing assessment district to provide for the continued maintenance,
operation and servicing of the Improvement Areas and Landscape Improvements, and for the payment of the costs
and expenses incurred for such maintenance, operation, and servicing; and
D. WHEREAS, the Developer is the owner of all of the real property to be benefited by the
Improvement Areas, and the maintenance, operation, and servicing thereof.

NOW, THEREFORE, in furtherance of the foregoing recitals, the developer does hereby petition the
City as follows:
1. In order to assure the continued maintenance, operation, and servicing of the Improvement Areas
and Landscape Improvements, and the payment of the cost and expenses incurred for such maintenance,
operation, and servicing, the Developer hereby requests that the City increase the FY 2006-07 maximum
annual assessment rates in Santa Clarita Maintenance District No. 1, Zone 1, Annexation 1-G (Centex
Development) (hereinafter referred to as the "Zone') pursuant of the "Landscaping and Lighting Act of
1972,"as set forth in Part 2 of Division 15 (Section 22500, et seq.) of the Streets and Highways Code of the
State of California in accordance with this Petition.
2. The property is currently within or proposed to be included in the boundaries of the Santa Clarita
Maintenance District No. 1, Zone 1, Annexation 1-G (Centex Development). The maximum assessment rate
for Fiscal Year 2006-07 established for the project is $107.28 per EDU per year ($8.94 per EDU per month).
In the event any of the parcels are subdivided, all subsequent parcels or EDU's shall be subject to the
assessment. The base rate may increase at an annual amount based upon the annual change in the Consumer
Price Index (CPI), during the preceding year, for All Urban Consumers, for the Los Angeles, Riverside and
Orange County areas.
3. As the owner of all of thereat property to an increase in the assessment rate, the Developer hereby
waives all statutory hearings of objections and protests by interested property owners to the proposed
annexation.
4. In consideration of the approval of the rate increase for the District by the City, the Developer
hereby proposes as follows:
a. To consent to the increase in the maximum annual assessment rate for the property in an amount
reasonably determined by the City to cover all costs and expenses incurred for the continued maintenance,
operation, and servicing of the Landscape Improvements for Santa Clarita Maintenance District No. 1, Zone 1,
Annexation 1-G (Centex Development).
b. To construct Landscape Improvements as may be reasonably required by the City;
c. To bear all costs to complete the construction or other installation of the Landscape Improvements
on those portions of the Improvement Areas within and adjacent to the development to the reasonable
satisfaction of the City;
d. To cast a ballot authorizing the levy of assessments in the District to pay the costs and
expenses of the continued maintenance, operation and servicing of the improvements and the signed
petition is part of the ballot. It is understood that:
The improvements are the landscaping in the medians and parkways within the Valencia Industrial
Center.
The assessment is apportioned to the benefiting properties based on Equivalent Dwelling Units
(EDU's) such that a Single Family Detached Residence (SFR) is equal to 1 EDU and all other
properties are converted to EDU's based on their relative benefit as compared to a SFR as follows:

PART A — PLANS AND SPECIFICATIONS
Contains a description of the improvements that are to be maintained or serviced by the District.
PART B — ESTIMATE OF COST
Identifies the estimated cost of the services or maintenance to be provided by the District, including
incidental costs and expenses in connection therewith.
PART C — METHOD OF APPORTIONMENT
Describes the basis on which the costs have been apportioned to each parcel of land within the
Maintenance District, in proportion to the estimated benefits to be received by such lots and parcels.
PART D — ASSESSMENT ROLL
Identifies the maximum assessment to be levied on each benefited lot or parcel of land within the
Maintenance District.
PART E — ASSESSMENT DIAGRAM
Contains a Diagram of the Maintenance District Boundaries showing the exterior boundaries of the
Maintenance District, the boundaries of any zones within the Maintenance District and the lines and
dimensions of each lot or parcel of land within the Maintenance District.

PART A
PLANS AND SPECIFICATIONS
DESCRIPTION OF IMPROVEMENTS TO BE MAINTAINED AND SERVICED
The improvements proposed to be installed, maintained and serviced are generally described as the
landscape improvements within public rights-of-way and dedicated landscape easements within
various tracts and on individual parcels located throughout the City. These improvements include the
installation, maintenance and servicing of landscaping improvements including but not limited to:
landscaping, planting, shrubbery, trees, irrigation systems, hardscapes and fixtures.
The District will fund costs in connection with the landscape maintenance and servicing including,
but not limited to, labor, electrical energy, water, materials, contracting services, administration, and
other expenses necessary for the satisfactory maintenance and servicing of these improvements.
Maintenance means the furnishing of services and materials for the ordinary and usual maintenance,
operation and servicing of the ornamental structures, landscaping and appurtenant facilities,
including repair, removal or replacement of all or part of any of the ornamental structures,
landscaping or appurtenant facilities; providing for the life, growth, health and beauty of the
landscaping, including cultivation, irrigation, trimming, spraying, fertilizing, and treating for disease
or injury; the removal of trimmings, rubbish, debris, other solid waste; and pest control.
Servicing means the furnishing of electricity for the operation of any appurtenant facilities, and water
for the irrigation and control of the landscaping and the maintenance of any of the ornamental
structures, landscaping and appurtenant facilities.
The plans and specifications for the improvements are voluminous and are not bound in this Report
but by this reference are incorporated and made part of the Report. The plans and specifications are
on file at the City.

PART B
ESTIMATE OF COST
The estimated maximum costs for the operation, maintenance and servicing of the facilities, shown
below, are the estimated costs of maintenance if the facilities were fully maintained for Fiscal Year
2006-07. The 1972 Act provides that the total cost of the maintenance and services, together with
incidental expenses, may be financed from the assessment proceeds. The incidental expenses may
include engineering fees, legal fees, printing, mailing, postage, publishing, and all other related costs
identified with the district proceedings.

The 1972 Act requires that a special fund be set-up for the revenues and expenditures of the District.
Funds raised by assessment shall be used only for the purpose as stated herein. The City may
advance funds to the District, if needed, to ensure adequate cash flow, and will be reimbursed for any
such advances upon receipt of assessments. Any surplus or deficit remaining on July 1 must be
carried over to the next fiscal year.

PART C
METHOD OF APPORTIONMENT OF ASSESSMENT
GENERAL
Part 2 of Division 15 of the Streets and Highways Code, the Landscaping and Lighting Act of 1972,
permits the establishment of Maintenance Districts by cities for the purpose of providing certain
public improvements which include the construction, maintenance and servicing of street lights,
traffic signals and landscaping facilities.
Section 22573, Landscaping and Lighting Act of 1972 requires that maintenance assessments be
levied according to benefit rather than according to assessed value. This section states:
"The net amount to be assessed upon lands within a Maintenance District may be
apportioned by any formula or method which fairly distributes the net amount among all
assessable lots or parcels in proportion to the estimated benefits to be received by each such
lot or parcel from the improvements."
The Act permits the designation of zones of benefit within any individual Maintenance District if "by
reason of variations in the nature, location, and extent of the improvements, the various areas will
receive different degrees of benefit from the improvements." (Sec. 22574). Thus, the 1972 Act
requires the levy of a true "assessment" rather than a "special tax."
In addition, Proposition 218 requires that a parcel's assessment may not exceed the reasonable cost of
the proportional special benefit conferred on that parcel. Proposition 218 provides that only special
benefits are assessable and the City must separate the general benefits from the special benefits.
REASON FOR THE ASSESSMENT
The assessment is proposed to be levied to defray the costs of the installation, maintenance and servicing
of landscaping improvements, as previously defined herein in Part A of this Report.
SPECIAL BENEFIT ANALYSIS
Proper maintenance of the landscaping and hardscaping within the public right-of-way and easements
provides special benefit to adjacent properties by providing community character and vitality. Trees,
landscaping, hardscaping and appurtenant facilities, if well maintained, provide beautification and
enhancement of the desirability of the surroundings; therefore, these improvements provide special
benefit to those developments that are directly adjacent to the landscaped medians and take their main
access off of these roadways.
Landscaping along the major thoroughfares of the City provides only incidental benefits to motorists
traveling to, from or through the City.

The improvements are the slopes, parkways and medians in street rights-of-way and easements
within the boundaries of the Centex Development, including in Golden Valley Road.
The assessment is apportioned to the benefiting properties based on Equivalent Dwelling Units
(EDU's) such that a Single Family Detached Residence (SFR) is equal to 1 EDU and all other
properties are converted to EDU's based on their relative benefit as compared to a SFR as follows:

The table below provides the assessment apportionment for the areas identified herein and shows the
estimated maximum annual assessment rate per Equivalent Dwelling Unit for FY 2006-07.

* The maximum annual maintenance assessment rates will be increased each year by the
annual change in the Consumer Price Index (CPI), during the preceding year, for All

Council and may not exceed the maximum assessment rate without receiving property
owner approval for the increase.
