SUBJECT: AGREEMENT FOR MAINTENANCE OF LANDSCAPE AREA
WITHIN THE STATE HIGHWAY RIGHT-OF-WAY (STATE
ROUTE 14 AT GOLDEN VALLEY ROAD) - APPROVAL OF
AGREEMENT

RECOMMENDED ACTION
City Council approve the Agreement for Maintenance of Landscape Area within the State
Highway right-of-way (Agreement), and authorize the City Manager or designee to execute the
Agreement, subject to City Attorney approval.
BACKGROUND
Tentative Tract Map No. 52414 (Golden Valley Ranch), consisting of approximately 1,259 acres,
located along the extension of Golden Valley Ranch Road, southeasterly of State Route 14 and
westerly of Via Princessa, was approved by City Council on January 24, 2002. The property is
owned by PacSun, LLC, a California Limited Liability Company.
The Conditions of Approval require current and future property owners, through a master
association, to be financially responsible for the maintenance of any required landscape areas,
including landscaped slopes on the commercial parcels along State Route 14. The Department of
Transportation is requiring the City of Santa Clarita, rather than the Golden Valley Ranch
Property Owners Association, to be responsible for the installation and maintenance of
landscaping on those portions of the landscaped slopes that fall within the right-of-way of State
Route 14. The Conditions of Approval require all phases of Tract Map No. 52414 (Golden
Valley Ranch), to be annexed into a Landscape Maintenance District (LMD) for maintenance of
landscaping within public streets.

The Agreement for Maintenance of Landscape Area within State Highway Right -of -Way
(see attachment) states that the City of Santa Clarita:
1. Is willing to fund one hundred percent of all associated design, capital outlay, maintenance,
and staffing costs;
2. Will submit plans to the state for review and approval, and will obtain all necessary
encroachment permits prior to the start of any work;
3. Shall apply for an annual maintenance permit; and
4. May contract with others to install and maintain the landscaping; which requires a separate
encroachment permit and letter of authorization.
ALTERNATIVE ACTIONS
Staff has not identified any alternative actions that would conform to requirements set forth in the
approved Conditions of Approval for Tentative Tract Map No. 52414 and the laws of the State of
California.
FISCAL IMPACT
The performance of this Agreement will have minimal impact on the City's budget. The
owner/developer, PacSun, LLC, a California Limited Liability Company, shall be financially
responsible for:
• The preparation, submittal and approval of the plans to the Department of Transportation;
• Encroachment permit fees to the Department of Transportation;
• Construction of irrigation systems and planting of landscaping; and
• The annexation of Tract Map No. 52414 (Golden Valley Ranch) into a Landscape
Maintenance District responsible for maintenance of the slopes.
